An overseas student has lost a Federal Magistrates Court appeal against a decision by the Migration Review Tribunal which held that a Master of Business Administration was not relevant to his nominated occupation of Pastry Cook for the purposes of an application for a Subclass 880 visa. The decision is significant in that it is the first ruling by a Court on this provision and the strict interpretation of the provision  by the Federal Magistrate will be a concern to many students who followed similar study pathways to the student in this case.
