Compulsory acquisition is legislated for under Section 51(xxxi) of the Constitution of Australia and can be carried out federally, or by the states, territories and local government agencies.
At the Commonwealth level, compulsory acquisition can be used whether or not an owner is willing to sell their interest in the land, when the land has no title, when an owner has difficulty establishing proof of title, or even if the owner cannot be found. Land can be acquired by “negotiated agreement” or, in cases of national emergency, by “urgent acquisition”.

Dunhill says compulsory acquisition is an unusual, intricate, and almost draconian area of the law, and it is not up the average person to have to deal with it alone.
Dunhill recommends claimants gather information from the acquiring authority (it could be anyone from the department of transport to the council or water authority) as well as seeking out people they can trust like lawyers and independent valuers who will look at it from their point of view, and fight for the right compensation while managing the process.
“Don’t listen to any one person’s or group’s views,” Dunhill cautions. “Even if everything they say is true and the information is right and accurate, it’s not being looked at from the claimant’s point of view, and their particular circumstances.”
“Even if the money is great it is still a terribly emotionally aggravating area because its not something you asked for – it is done to you,” Dunhill says. “Most of our clients are happy with the way its been managed, but they say, nonetheless, they’d be very happy if it never happened to them.”
