Child restraints in taxis
The Victorian child restraint road rules do not require taxi drivers to provide child restraints or booster seats for customers. However, the road rules do require taxi drivers to ensure there is at least one anchor fitting ready for passengers who wish to supply their own restraint.
The Victorian child restraint road rules require that in taxis:
Children aged under 1 year do not have to use a child restraint, but they must travel in the back seat.
Children aged 1 year and over must be seated in their own seating position in a taxi, with their own properly fastened seatbelt if no suitable child restraint or booster seat is available in the taxi.
Kidsafe recommends taking your child’s restraint with you when travelling in a taxi if possible.
I am picking someone up at the airport and they have a young child. Do I need a child restraint?
It is the driver's responsibility to ensure child restraints are fitted and used. If the visitor cannot bring their own restraint, a restraint can be hired. If they choose to use a taxi, they do not need to use a restraint, however the department recommends always using child restraints unless in an emergency.
Do buses and taxis need to provide child restraints?
No. All taxis will have an anchor bolt that can be used to fit a child restraint, however not all taxis will have a child restraint so you may need to provide your own. As taxis do not have to supply child restraints, parents/carers are advised to provide their own. A parent/carer without a child restraint should not include the child in their seatbelt.
A bus is a vehicle that has 13 or more seats, including the driver. A bus does not need to be fitted with seatbelts and child restraints are not required.
The seatbelt rules do apply to a vehicle that has 12 seats and all passengers must wear seatbelts if they are fitted. If seatbelts are fitted child restraints must be used.
