Building friendly and harmonious relationship between neighbors needs bilateral cooperation, which means compromise and sacrifice from both sides. Unfortunately, people takes your kindness and consideration in the dark way, thereby considering you are soft and trying to take advantage from you, which is a typical case in the western culture.

只是提醒下lz, 你的律师对于竹子和palm tree 的两个问题只是对邻居提出要求 但是没有对应上相关法律条文来证明要求是合法合规的

谢谢提醒，我找了下，在第一封信中律师提到的是事实，有可能的后果，相关的act。我个人觉得没必要再对具体的act再进行展开大论述，毕竟我们的诉求符合逻辑及common sense。

The bamboo has over time grown through or under a brushwood fence erected within your land into the space between that fence and the common boundary fence and then over the shared boundary and through the boundary fence into our client’s property. The growth caused or contributed to the collapse of a feature wall erected on our client’s property and is causing damage to the boundary fence.

The palm trees drop fronds from time to time from a considerable height. The fronds are large, relatively heavy and have hard and abrasive elements. have the potential to cause injury or damage and have landed in our client’s property from time to time.

As such, both the bamboo and palm trees are creating nuisance and are liable to be the subject of orders to remedy damage and prevent further damage or injury under the Act.

这个解释不太合理 我之前也找律师做过好几个不同的事情
律师一般都会在信里面引经据典 讲到一个人家不合规或者我们合规都会refer一下某一条法案
你看你的邻居回信里面都知道要引用某一条法案来支撑他的论点 不管是不是对的
这个lz可能要和你律师问一下 有没有哪条法案是支持你的诉求的 最好让律师找出来相关法案条例 你自己也可以读一读 心里有个底

再次感谢建议。
我的这个case其实很小，全是在Trees (Disputes between Neighbours) Act 2006适用范围。

律师也是在信中开始就讲到，
Along the rear of your property and adjacent to the shared boundary is an established stand of bamboo and 5 large palm trees. Both are ‘trees’ for the purposes of the Trees (Disputes Between Neighbours) Act 2006 (the Act).

然后提到的都是跟这个act有关的
As such, both the bamboo and palm trees are creating nuisance and are liable to be the subject of orders to remedy damage and prevent further damage or injury under the Act.

之前我看过数个类似case，适用的都是这个Act 2006，也都是在案件详述里唯一提到的Act。

我觉得吧，palm tree那个很难赢。你说他们没有maintain，他们说他们有maintain。没有一个很量化的标准什么是no maintenance,还是 badly maintained, 还是maintained，还是well maintained。还有，如果他们的树枝掉到你们那边，砸坏了你们的东西，是需要你们自己报保险，自己交垫底的。
竹子这个事情，现在他们同意搞，只要他们是按照澳洲标准做了，最多你们要求提供证书，保证符合标准。如果说要求这个做的barrier要保证forever，没有谁可以保证得到，法官也不会判一个东西可以guarantee forevee的。
所以我不看好这个官司。

看了下Act 2006. part 2. Section 9. (h) & (i) ,

(h)  if the applicant alleges that the tree concerned has caused, is causing, or is likely in the near future to cause, damage to the applicant’s property:
(i)  anything, other than the tree, that has contributed, or is contributing, to any such damage or likelihood of damage, including any act or omission by the applicant and the impact of any trees owned by the applicant, and
(ii)  any steps taken by the applicant or the owner of the land on which the tree is situated to prevent or rectify any such damage,

(i)  if the applicant alleges that the tree concerned is likely to cause injury to any person:
(i)  anything, other than the tree, that has contributed, or is contributing, to any such likelihood, including any act or omission by the applicant and the impact of any trees owned by the applicant, and
(ii)  any steps taken by the applicant or the owner of the land on which the tree is situated to prevent any such injury,

法官判断的标准就是怎么证明palm tree会造成伤害, 然后证明邻居没有做任何动作去防范， Lz需要提证

我觉得你的邻居应该是已经仔细研究过这段，所以他一直在强调他们一直有维护这些树，包括修剪，而你们总是不maintainence自己的院子。 感觉你的邻居蛮狡猾的， 可能你要在这方便多多下功夫搜集证据，强有力的证明是他们不维护，导致大的落叶掉你们家，极有可能产生财产和人身安全的concern.

1. 他家的PALM TREES离公共篱笆只有1米左右的距离，满树的枯叶对我们高活动性的院子区域造成的就是潜在的hazard，而且之前已经砸坏了一些院子里的小物件。我们信中写得很清楚，希望他们将枯树叶去除以减少坠落风险。这是一种很合理的要求。那些随机的大树枝砸坏邻居院子里的东西是属于不可防范的偶然事件，跟我case中的已经预见完全可以预防的坠落风险有着本质的区别。

2. 这是种clumping bamboo，只要按照标准，竹根是可以做到完全控制的。我们是让他们通过有资质的contractor来进行铺设barrier。
