嗯,council的draft condition是对方amended planning的一部分,必须遵守。 其中涉及我家这边的overlook, council下面几个关键的要求我觉得还是合理的。
Unit 3 proposed alfresco to be setback a minimum of 4.0m from the rear (southern) boundary.
f) Overlooking measures are required for the following window(s)
i) Dwelling 1, first-floor master bedroom east-facing window;
ii) Dwelling 2, first-floor bedroom 2, siting room east-facing windows; and
iii) Dwelling 2, first-floor bedroom 3 and master bedroom west-facing windows; and
iv) Dwelling 3, first-floor bedrooms 2 and 3 west-facing windows.
Overlooking measures must comprise of:
v) fixed, obscure glazing (not removeable film) in any part of the window below 1.7m above floor level; or
vi) permanently fixed external screens to at least 1.7m above floor level which are no more than 25% transparent; or
vii) Obscure glazing in any part of the window below 1.7 metres above floor level may be openable (to a maximum of 150mm) provided that there are no direct views as specified in standard B22, Clause 55.04-6, Maroondah Planning Scheme; or
viii) Overlooking Section Diagrams showing sight lines at 1.7 metres above the floor level of the window demonstrating there is no overlooking into neighbouring SPOS to the satisfaction of the Responsible Authority; or
ix) Overlooking Section Diagrams showing clear sight-lines taken at 1.7 metres above the FFL which demonstrate that that is no overlooking into neighbouring (and internal dwellings within the development) secluded private open space and habitable rooms windows within 9.0 metres from the proposal’s ground-floor and first-floor unscreened habitable room windows and decks in accordance with Standard B22 of ‘Clause 55.04-6: Overlooking objective’ and Standard B23 of ‘Clause 55.04-7: Internal views objective’ of the Maroondah Planning Scheme.
