我的情况没有你这么复杂。我的前房主在那里住了将近五十年，而且去世了。fence一直都在，确实挺老的。

好多年的贴子给翻出来了。统一回复：我遇到的是两个良心西人老人， 不同意全部还给我（否则离他家房子太近），让回一大部分。换fence的钱我要一个人出，他要平分说这是应该的。最让我感动的是换fence时他们都不在家，去乡下了，他们的信任让我真是感动。他告诉我，如果我当时乱来，他30年前立fence的照片和收据都留着呢，完全可以申请把地规划给他们！他说以后买房子的时候会讲清楚这fence位置不对，有我的地。将心比心，讲究诚信。我们成了好邻居。

遇到这种情况，我觉得还是想周到，有时需要换位思考，找到一个折中方案。他要真正把地要回去，也不是简单的事。你要把地要回来也不容易。

我怎么觉得你这种情况他们无法claim adverse possession ？

Limitation period

Different jurisdictions have legislated different periods of time after which an occupier can claim adverse possession of the land they are occupying. In Victoria, this period is 15 years.

Section 8 of the Limitation of Actions Act provides that a person cannot recover land more than 15 years after their right of action accrued to them. Therefore, 30 years after a person goes into adverse possession of land, they are no longer entitled to make a claim for legal ownership of the land.

看第二段，我感觉这个意思是 Even if the fence has been on the same place, however if your neighbor didn’t claim reverse possession between 15-30 years, they will lose the right to claim it after 30 years?

Adverse possession不适用于一部分土地，要么全部，要么没有。

找律师花了几百块钱咨询了。就是我说的，他要真正拿走不容易，你要要回来也麻烦。商量一下看看有没有办法。
