刚装上,不过那个免费的猫可够差的,就像是块大砖头 ,还有再花钱买router

是Cisco 2203吗?我感觉比Netgear的好,带备用电池,就是不支持无线。不过你可以自己接一个无线Router。

Misrepresented download quota.
Competition watchdog the ACCC will seek to make Optus run corrective advertisements and pay civil penalties after the Federal Court found the telco ran misleading advertisements for its ‘Think Bigger' broadband plans.

The Australian Competition and Consumer Commission (ACCC) also sought an order for an injunction that prevented Optus from advertising its broadband services in a similar manner for the next five years.

Optus argued any injunction should span only three years. A ruling was expected to be made this afternoon.

The advertisements offered large broadband quotas split into peak and off-peak quotas, accompanied by the words ‘Think Bigger'.

The ACCC argued they were misleading because they did not adequately disclose that if a customer used all of their peak allowance, "the service would be throttled back to 64kbps both for the peak usage and, more importantly, for the off-peak usage", according to a judgment filed late Friday.

"After the peak allowance was depleted, the consumer would not get the benefit of any of the remaining off-peak entitlement... at broadband speeds," the judgment stated.

Justice Nye Perram said that the plans "misrepresented the quantity" of broadband that Optus was offering to provide.

"Customers were not being sold plans which gave them the nominated amount of broadband. They were given plans which had that amount as the maximum usage which could be obtained and, even then, only by careful use," Justice Perram wrote.

"The plans in question did not have the quantity suggested for them. They were not 120GB, 150GB or 170GB plans at all.

"The Commission placed its case on s[ection] 52 [of the Trade Practices Act] and is plainly entitled to succeed under that provision in relation to all of the advertisements on the basis of the failure adequately to disclose that once the peak data quota was reached no further use could be made of the off-peak allowance."

Of the 150GB advertising flyer, Justice Perram said: "Viewed in isolation at the moment of its delivery, this advertisement plainly misleads consumers into thinking that they will receive 150GB of broadband when they are getting no such thing unless they assiduously ensure that they exhaust all of their off-peak usage allowance before exhausting their peak usage allowance."

He also rejected arguments by Optus that the "misleading nature of the advertisement [was] reduced by the statements Optus makes, or seeks to have made on its behalf, at the point of sale."

Optus had argued that advertisements only served to "put customers on inquiry" and that the full details of the plans were disclosed at the point-of-sale.

Justice Perram found in favour of Optus on the issue of the impact of 64 Kbps throttle speeds, believing a reference to it in the footnote was "sufficient".

The ACCC had sought to have the throttle speed labelled as "sub-broadband".

Judgment on the period of the injunction against Optus was due later today. Further directions were set down for Friday.

Argues against ACCC corrective campaign.
Optus customers that felt they were misled into signing up to the ISP's 'think bigger' and 'supersonic' broadband plans could exit their contracts without penalty, the ISP's lawyers said in the Federal Court today.

Affected customers would receive notification of the escape offer directly by mail and would also potentially be able to view it in corrective advertisements sought by the Australian Competition and Consumer Commission (ACCC).

However, the ISP claimed "there had been not one complaint from a contract being entered into" by a consumer, despite an undisclosed but allegedly sizable number of sign-ups to the plans.

The Federal Court this week found Optus' advertising campaign for the broadband plans to be "misleading and deceptive".

The Australian Competition and Consumer Commission (ACCC) today argued its case for the extent of corrective advertising it sought as part of a court order.

But Optus proposed limiting corrective advertising for its 'think bigger' and 'supersonic' broadband plans only to customers that signed up for the services, rather than engage in a broader campaign proposed by the ACCC that the ISP viewed as an "exercise in punitive self-flagellation".

High impact

The watchdog's barrister Neil Williams SC said that Optus' advertisements were "high impact, eye-catching and distinctive".

He argued that Optus should be forced to run corrective advertisements to the extent that the original campaign was run, including in primetime slots on subscription TV, in non-primetime free-to-air slots and in newspapers.

Williams argued that TV advertisements had a "lingering impression" in consumer's minds "that Optus offered a very fast broadband service very cheaply."

He said the impression could span "some two or three months, indeed even longer after a campaign has finished."

Corrective TV advertisements proposed included a "20-second [screen]... which we think sufficiently summarises the [corrective points to be made], followed by two seconds of the Optus logo."

Other corrective measures proposed by the ACCC allegedly included pop-up ads on all Optus web properties, an "A3 [sized] notice" in all Optus stores and a letter to customers with the heading "corrective notice of the Federal Court of Australia", rather than a personal greeting, according to the telco's barristers.

Advertising court win?

Optus lead barrister Steven Finch SC was critical of the ACCC's list of demands, which he claimed were designed to "grandstand and punish rather than to correct."

Finch argued that the response was akin to a product "that caused death", not one about the terms of a broadband plan.

He said that the proposed corrective TV advertising campaign "sought first to repeat confusion [in the offending advertisements], then to seek to so-called correct it by a densely-packed sermon."

Finch claimed that the corrective "sermon" proposed by the ACCC - which was "presented in alarmingly funereal terms" - would result in "20 seconds of dead air while the customer watches with bemusement while it scrolled across the screen."

He argued that such a campaign wouldn't reach "anyone who might have been caught out" by the original campaign and that it "may miss the point".

"We propose the actual correction be directed to those who've actually signed up," Finch said.

"We say, in the circumstances, that will be enough.

"[The ACCC's ad] isn't a correction. It's an advertisement of the ACCC's win in the proceedings. The TV advertisement shouldn't be ordered because it's ill-directed and potentially confusing".

That drew a rebuke from the watchdog's barristers.

"It's corrective and directed at consumers," Williams responded. "It has no mention of the ACCC."

Finch claimed that corrective newspaper advertisements were "further divorced from reality" and also argued against running pop-up ads on its website and corrective posters in Optus retail stores.

He argued that corrections should target those potentially caught out by the original campaign, not more broadly.

A decision was expected to be handed down by the Federal Court next week.

Misleading or deceptive conduct by Singtel Optus Pty Limited

The Federal Court has found that Singtel Optus Pty Limited (Optus) engaged in misleading or deceptive conduct through its "THINK BIGGER" and "SUPERSONIC" advertising campaigns for internet broadband plans.

This follows legal action by the Australian Competition and Consumer Commission.

The advertising claimed that on the plans a consumer could access internet broadband over peak and off-peak time periods. However, the offer was subject to further conditions that were not sufficiently or clearly disclosed.

Specifically, once the monthly peak period data had been exceeded, the customer's speed would be limited to 64kbps for the remaining unused off-peak data.

As a consequence, a consumer subscribing to any of these plans may not be able to use all the off-peak period data allowance within the monthly period once the speed has been limited.

The plans at issue were the "Think Bigger" plans offering 120GB (50GB peak + 70GB off-peak for $49.99) and 150GB (75GB peak + 75GB off-peak for $59.99); and the "Supersonic" Internet broadband with Premium Speed Pack plans offering 120GB (50GB peak + 70GB off-peak for $69.99), 150GB (75GB peak + 75GB off-peak for $79.99) and 170GB (85GB peak + 85GB offpeak for $89.99).

Optus launched the "Think Bigger" campaign on 25 April 2010 and the "Supersonic" campaign on 2 August 2010, with advertisements on television, in newspapers and flyers, and on the Optus website and billboards.
