动机(motive)不是谋杀罪名成立的要素，意图(intention)是。检控需要证明的是，被告行为的意图是杀死被害人。不需要证明被告谋杀动机，谋杀意图从何而来，为什么要杀死被害人。本案检控没有提出被告的谋杀动机。

检控需要排除合理疑点地证明的谋杀定罪四要素，其中之一是意图。动机通常是检控论述很重要的一部分，但不是谋杀罪名成立的要素之一。这是很确定的法律原则。
