Thank you for contacting us about the Not as Described case (5082******) that was opened for item 'NEW **** HEADPHONES' (3************). I understand that you’d like to appeal our decision, and I’d be happy to assist you.
I’m sorry to hear that you’ve received a faulty item back which you've mentioned is not the item that you've sent to the buyer. I know that it can be disappointing to have a Not as Described case closed in the other person’s favour. I have looked into this and unfortunately, the appeal has been denied and I’d like to explain how we reached our decision.
When dealing with Not as Described cases James, we always ensure that we remain impartial, and make the fairest decision that we can. After the buyer filed their Not as Described case, you were allowed at least 3 business days to resolve their complaint. As you were unable to provide a resolution that they were happy with during this period, we decided that the best solution was for the buyer to return the item to you for a full refund.
If you’re unhappy with this Not as Described case being opened, there are a few things that you can do.
You can block the buyer
If you wish to block this particular buyer from purchasing your items in the future, you can find instructions on how to do so by following the steps below:
1. From the eBay Homepage, click “Help & Contact”
2. Enter “block a buyer” into the search bar
You can report the buyer to our Account Investigations team.
To report a buyer to our Account Investigations Team:
1. From the eBay Homepage, click “Help & Contact”
2. Enter “report a buyer” into the search bar
3. Choose the help article “How do I report a buyer who is misusing returns”
4. Open the link “report the buyer to eBay” and fill out necessary information
Speak to Australian Competition & Consumer Commission (ACCC)
If you’ve been unable to come to a resolution with the buyer, you can choose to contact ACCC, depending on the amount of the item.

Small Claims or Money Claim online:
Depending on the value of the transaction, you may want to take the matter further and file an official complaint against the buyer. I suggest for you to contact the Law Enforcement if you can't reach the seller or if he won't resolve this matter. For Contacting Law Enforcement, you can file a complaint with the relevant State Police on the Queensland Police hosted Website. Follow the information and links to report it to the correct State Police:

If you do contact police, let them know that eBay may be able to help their investigation and that they can contact us by going to:

I know that this wasn’t the answer you were hoping for, but I hope that this information explains our decision. Thanks again for contacting us again, and I wish you the best of luck with your future online trading. |
