I was disappointed with the decision by Tribunal, since my request was dismissed.
Due to my work conditions, my wife turned up on behalf of me.
My refund request was based on the two reasons:
1. Major failure - A product or good has a major problem when it doesn’t do what the business said it would, or what you asked for and can’t easily be fixed. The tribunal did not support this, since the car was repaired.
This decision was acceptable, since i was not able to provide the independent mechanical report to identify from technical point of view.
2. Misleading
There had been two occasions of misleading conducts. The first one was the sales who told that the car had not been driven for a long time, since all new cars just need to drive to/from ports. However, the dealer principle told in the meeting that all new cars have the pre-delivery which includes road testing; and the service manager told in the meeting that all new cars need to drive to top up fuel.
The tribunal was not satisfied with my statement. In stead, the tribunal accepted the evidence from MBS that all new vehicles require a "run in" period immediately following delivery.
I was not happy and confused by this, since my statement did not have much relationship with MBS's evidence.
The second misleading was the statement from DP "No way for a refund". I was very disappointed that it was not even mentioned on "Notice of Order".
I am still not convinced by the decision from the tribunal. I was not sure if it had some impact due to my wife's English. In addition, I suspected the real reason why MBS requested for a adjournment. |
