For Owners whose builder goes insolvent. What to do when construction stops and the unthinkable happens.
There are many steps involved in recommencing the construction of your home if your builder goes insolvent.
In summary:
•Cease making payments immediately
•Contact liquidator (for Porter Davis customers, that’s Grant Thornton 03 83202222)
•Ensure your site is safe & secure (remove signage, change locks, site fencing)
•Obtain termination of existing contract in writing
•Obtain release of copyright for existing plans
•Obtain contract plans & accompanying documents
•Obtain Certificates of Compliance
•Obtain Building Permit & associated documents
•Arrange amendment to Building Permit to appoint new Builder
•Arrange CCTV inspection
•If any defective works arise during construction with your new Builder, make a new claim with the VMIA
•Obtain your own independent legal advice
