[会计] contractor要不要签contract啊? [复制链接]

我知道这个问题很小白,不过还是想上来问大家一下。
新财年老板突发奇想要我注册个abn做他的contractor,那我要不要和他重签合同阿?虽然同样的上班时间,同样的工作内容。本来刚开始工作的时候签过permenent的合同的。。。
还有不知道每次涨工资的话要重签合同吗?因为涨过两次工资(起点太低,所以涨了)都没重签过。。。
大家会不会觉得变成contractor更加没保障了?

There isn't any legal tax advantage to being a contractor,  unless you can get more for being a contractor than full time employee, there isn't any real advantage to you.
Based on the information you have given, whether you sign or contract or not, wont change the fact that you are a deemed employee for tax purpose. you probably need to speak with an lawyer to find out whether your rights are protected as a deemed employee.

我已经作contract快4年了,contract唯一的好处就是钱,如果给你的salary都一样,看不出你有任何理由同意。

如果钱一样多的话, 从PERM转到CONTRACTOR相当于把你的薪水打7折, 可能还不止.

同意9楼的,contractor如果hourly rate还不高的话,没有一点意思。一般的大公司,同等位置,contractor的工资要比perminant要高的。大家各取所需。公司比较灵活,个人能多拿点钱,但是抗点风险。

说到钱的问题,本来是按照hourly rate来结算工资的,以后contractor了就按公司收入的百分比来算了。如果按这个财年的收入来看,应该是会比hourly rate的方式多一点的,所以老板提出的时候我也没有异议,本来我以为就是个9%super的区别,现在看到上面的tx说要按7折比较,我有点慌了

你自己的ABN可能需要自己报GST,那么10%就没了,super还是其次。

另外公司是不为contractor买保险的,你如果在工作中受伤,是需要自己付钱的。

没有sick leave,没有年假,总之,请假一小时就扣一个小时的钱。

但是contractor的好处是可以报一些退税,比如你的房租,水电,汽车,汽油,吃饭。

总之是差不多的,而且繁琐很多。

correct, I have to pay insurance like work cover by myself, totally more than 2000$ one year. But for GST, you can ask your boss that your contract rate is inclusive GST or not. E.G, your contract rate is 100$/per hour,  if exclusive GST you can get 110$/per hour.

but you can hold all tax to next year and put into your offset account.

how do you subcontract work to your no-income student friends, when you work at a place as a full time 'employee'?
The issue here is that, if you are a deemed employee, and you have been claiming all your private expenses, rent, travel to work etc. one day the ATO does an audits on you, you not only have to pay the taxes missed all these year, plus interest at 11-12%. you potential liable for penalty of up to 75% of your total tax. and certainly don't believe for a second that your accountant will take any of those responsibility. so the question is are you confident that you will not even get a single audit in your entire working life?

i have been here for over 15 years, mate. i do think it is a serious subject, if you think you are smarter than everyone else and won't ever get caught, the least you can do is to keep it to yourself. don't go around tell everyone about your own dodgy tax schemes, craps like this spreads like cancer.
i can tell you now, what you are doing, others have done it before and got into troubles for it.

I think you still can claim deduction (on percentage such as 30-50%) for business costs such as, rental, electricity, some petrol, even mobile.

Surely not the dining out, water, etc..

Back to the topic for contractor, the big risk here is the employer can terminiate your contract with maybe 1 month notice, and the redundance package as permanent maybe much more, depends on how long you stay in the company.
