SPECIAL CONDITIONS:
1. The RENTER/s agrees to accept the property on an as is basis (i.e. as inspected) and makes no claim on the rental provider for modification, rectification or replacement on the property & the RENTER/s acknowledge the property’s current condition and understand that the rental is reflective of this. The RENTER/s are aware that the property rental has been discounted to reflect its current condition.
2. URGENT REPAIRS: The agent advises the RENTER/s that the agent has no authority to organise urgent repairs without first receiving the RENTAL PROVIDER’s consent.
3. The RENTER/s agrees that they are responsible for the replacement of light globes and tap washers during the period of the tenancy.
4. The RENTER/s acknowledges that they are responsible for the removal of insects, vermin and animals during the tenancy.
5. The RENTER/s acknowledges that should at any stage a gas/electric appliance fails; they will take all necessary steps to check pilot lights/fuses before reporting it to the agent. Should a tradesperson attend a property at the RENTER/s request and find that this has not been done; the RENTER/s is liable for the tradesmen account.
6. The RENTER/s acknowledges that the television aerial is not part of the tenancy and not the RENTAL PROVIDER’s responsibility. The RENTER/s also undertakes to seek permission from the rental provider/agent should they wish to connect cable/satellite TV.
7. The RENTER/s acknowledge the telephone land line is not part of the tenancy and not the RENTAL PROVIDER’s responsibility. The RENTER/s also undertakes to seek permission from the RENTAL PROVIDER/AGENT should they wish to have a telephone land line connected.
8. The RENTER/s acknowledge that the property will be cleaned prior to occupation and the RENTER/s agree to clean the property at the termination of the Tenancy Agreement, the RENTER/s also agree that they will professionally steam clean the carpets using xxx preferred cleaner at the termination of the Tenancy Agreement.
9. The RENTER/s understands that their application is accepted on the basis that the RENTAL is paid in full on the due date. The RENTAL amount must be made in one payment and not in separate instalments by individual RENTER/s (Refer clause 18 of this agreement.)
10. The RENTER/s agree that should it be necessary for them to break this lease agreement that they will pay the RENTAL PROVIDER’s cost and rental until a replacement renter is located, these being a letting fee equivalent to 4.4% of the annual rental, any advertising costs and rental until the property is re-let and the replacement renter takes possession.
11. The RENTER/s must check each smoke detector installed in the premises regularly to confirm that it is kept fully operational. These checks are to ensure the safety of the RENTER/s and the security of the premises. The RENTER/s must replace the battery in each smoke detector as required. The RENTER/s must notify the Agency of any faulty smoke detector (and confirm this advice to the Agent in writing the same day).
12. The RENTER/s agrees that the property is to be cleaned and the carpets are to be cleaned by xxx cleaners only and can contact the office to make arrangements, no other form of cleaning or outside cleaners will be acknowledged under this agreement.
13. The RENTER/s agree that it is their responsibility to connect all communications to the premises and that the rental provider cannot be held responsible for any extra charges that any authority may levy.
14. The RENTER/s acknowledges that the property is to be occupied by the applicant/s only and the RENTAL PROVIDER does not give permission for any Sub-Letting/Sharing of the premises. Refer clause 18. Strictly no short-term online accommodation listings.
15. The RENTER/s agree that all maintenance requests will be provided in writing via email to the agent at xxx containing the address of the property and the contact details for tradesmen to call. It is understood that NO VERBAL maintenance or TEXT message requests will be accepted under any circumstances.
16. The RENTER/s agree that should the lease be extended or if the lease was to become periodic, they will not vacate the property during the months of June, July, August and December unless overwritten by the lease term in the schedule.
17. The RENTER/s agree not to smoke or allow another person to smoke inside the dwelling.
18. The RENTER/s agree not to hold the AGENT/RENTAL PROVIDER responsible for any error in the property marketing and undertake to conduct their own enquiries in relation to any services provided or connected and any features related to the property, especially those services and features that are important to the RENTER/s decision to lease the property, PRIOR to committing to the lease agreement.
19. The RENTER/s acknowledge that the connection of the Internet and a phone line (if required) is to be at their cost and the RENTAL PROVIDER/s is/are not responsible for any associated costs such as running extra wiring or upgrading the premises to cater for a new or faster connection required by the RENTER/s.
20. The RENTER/s have acknowledged that they have been financially affected by COVID 19 yet warrant that they are able to afford the asking rental on the property and will make no claim against the RENTAL PROVIDER/s to defer or abate the rental during the term of the tenancy as a result of COVID 19.
21. The RENTER/s agree that should they wish to transfer the lease agreement during the tenancy that the AGENT will need to process an application from the replacement RENTER/s and approve them BEFORE they take possession and that the agents fee of $990 (inc GST) is to be paid prior to replacement leases and bond transfer documentation is drawn up.
