辞职，老板用3个月notice period为难，求建议

圣诞夜收到offer，为了让老板过个安心圣诞，把辞职信留到今天发。
翻了下合同，其他同事传说中的3个月notice在我的合同上的确也有（该打，签合同的时候不能只看薪水）。
老板刚才在电话中也提到，有三个月的notice。但是他不是那么强硬，他让我去联系新东家，看看是否能够推迟新工作开始日期。

坛子里面有没有其他同学遇到过类似情况？可以给些建议吗？

我觉得是合法的，签了字感觉只能认了，想想怎么解决这个事情吧。

看你的award,和award相悖的合同条款，以award为准。。
没有查看award,完全知觉告诉我，我觉得1week的notice就够了。

问问fairwork吧，感觉不是合同怎么写的就一定合法的样子

12. Termination of employment

12.1 Notice of termination is provided for in the NES.

12.2 Instead of s.117(3)(a) of the Act,in order to terminate the employment of an employee the employer must give the employee one month’s notice.

12.3 Notice of termination by an employee

The notice of termination required to be given by an employee is the same as that required of an employer except that there is no requirement on the employee to give additional notice based on the age of the employee concerned. If an employee fails to give the required notice the employer may withhold from any monies due to the employee on termination under this award or the NES,an amount not exceeding the amount the employee would have been paid under this award in respect of the period of notice required by this clause less any period of notice actually given by the employee.

这个是说雇员也是1个月吗？我帮楼主问的，呵呵

协商一下呗，那边推迟了一点，这边要早一点。不会弄的太僵。毕竟你人在心不在，也是没意思。

我们公司的合同就是要4个星期 结果一个同事要求只给两个星期notice，她就是把award翻出来 结果hr没办法 只能同意

老板是不是强硬完全取决于他能不能很快找到替你的人，如果他能找到，你立刻会叫你走人，如果不能，他就会越来越强硬。

最好别直接拿award来压老板，容易把关系弄得太僵。好好商量一下，估计能同意你按一个月的notice离职。

看着 MA000065，其中
12.1 Notice of termination is provided for in the NES.

按字面解释，雇主 ”must“ give one month notice ， and notice by employee is the ‘same’

那岂不是一个月就可以了？

其实老板也怕，一般情况下如果好聚好散的话，一个月足够交接了； 如果闹僵了，老板一般会宁愿给pay in lieu ，而不是硬留你的，因为怕你搞破坏， 特别是 programmer这行 ， 哈哈

以上难道说13年12月4日以后的合同，都要13个星期的notice?

还好我是老合同。。
