公司给的合同里面有个12个月的限制,具体如下。
请问这个合理吗?如果将来离职,是不是12个月啥都干不了了。。。。。如果受雇于其他相关领域的公司,会有问题吗?

“Restraint” means:
1)        during the Restraint Period and in the Geographical Area not carrying on or being engaged, involved or otherwise interested in, or concerned with (whether directly or indirectly or alone or in partnership or joint venture and whether as trustee, principal, agent, shareholder, director, unitholder, consultant to or in any other capacity), a Competitive Business (other than as the holder of less than a 5% legal, beneficial or economic interest in shares or other securities which are issued in the capital of a public company whose shares are quoted on a stock exchange); and

2)        during the restraint period not to either alone or in association with others

(i)        solicit, or facilitate any organization with which the Employee is associated in soliciting, any Employee of the Employer or any of its subsidiaries to leave the employ of the Employer or any of its subsidiaries;
(ii)        solicit for employment, hire or engage as an independent contractor, or facilitate any organization with which the Employee is associated in soliciting for employment, hire or engagement as an independent contractor, any person who was employed by the Employer or any of its subsidiaries at any time during the term of the Employee's employment with the Employer or any of its subsidiaries (provided, that this sub- clause 2)(ii) shall not apply to any individual whose employment with the Employer or any of its subsidiaries has been terminated for a period of one year or longer); or
(iii)        solicit business from or perform services for any customer, supplier, licensee or business relation of the Employer or any of its subsidiaries, induce or attempt to induce, any such entity to cease doing business with the Employer or any of its subsidiaries; or in any way interfere with the relationship between any such entity and the Employer or any of its subsidiaries.
“Competitive Business” means any business with which the Employer competes in the Geographic Area.

这个貌似就是竞业协议。澳洲如何处理不清楚,国内的话离职后公司需要给封口费的,不给钱,不补偿,让人怎么活~

个人认为应该没啥关系吧。否则公司里的人都不能跳槽了

国内是这个路子。

所以大家都认为是废纸一张。

这里,会怎么认定那?

对,竞争协议就这样。所以你要争取,可以要求缩短时间,或是补偿金,或是竞争对手的定义。实在争取不了就看着办了,理论上公司可以告你,但很多公司也睁一眼闭一眼。但我也知道有打官司的,有在试用期因为竞争协议辞职的。

据说有判例,不能工作的期限公司要给补偿,否则就是unfair clause,无效。

请律师朋友确认。
