关于Occupation certificate的问题

最近让Builder做Tender，问了关于项目时间进度的问题。Builder说他们不负责办理Occupation Certificate，应为很多事情并不在他们的控制范围，而且申请时间很长但并不影响入住。

我的理解是没有Occupation Certificate就入住是不合法的。有没有熟悉建房的高手帮忙解释一下。

Occupancy certificate  是building surveyor 签发给申请人的，只有所有东西都符合building surveyor 要求，才能拿到这个certificate, 所以，找builder的时候，一定要让builder包到最后拿到这个certificate, 再付builder 最后一部分钱。

我的是private builder，可能不一样，等的应该不久吧，不过当时在holiday，也没在意等了几天

Builder 是没有资格给Occupancy Permit的， 别弄错了。 一切还是他后面的Building surveyor说了算。 没有Occupancy Permit代表 Final inspection没过 , 必须让他包。 不包就找别人， 别用他。7楼说的对，最后一笔钱必须等到你有OP才给。

What is an Occupancy Permit?
An Occupancy Permit is a certificate we issue to indicate we're satisfied with the works and that we approve your building as being suitable to occupy from a health and safety perspective.

The Building Act 1993 requires the issue of an Occupancy Permit prior to occupation of a new building.

It is an offence to occupy a new home that does not have an Occupancy Permit.

我记得是 builder 先给提供 interim occupancy certificate, 然后自己搞好花园（前提是 builder 不包花园），再找 council 验收

With respect to occupancy permits, section 42 of the Domestic Building Contracts Act 1995 sets out the conditions to be met before a builder can request a final payment from you. The final payment cannot be claimed until the work carried out under the contract has been completed in accordance with the plans and specifications set out in the contract and the building owner has been given either a copy of the occupancy permit or a copy of the certificate of final inspection. You should read the contract and if you don’t understand it, seek legal advice.

花园包不包要看当时的合同了。 一般builder报价不包括只是为了让顾客一开始看见的数目没有这么大而已。 很多Local builder会包括进去的。

包的， builder必须提供所有相关的certification给pca or council 来拿oc。

如果不包的话， 那不是全乱套了， builder 盖的房子不是没人检查了吗？

我们盖的房子都是包OC的，但是PCA检查的费用是OWNER出。

而且钱都是扣到拿OC才全款付的， 那不到OC是BUILDER的问题， 你可以不给钱的。

不知道会否有人知道,如果新房子已经出了strata plan但是occupation certificate迟迟出不来,是不是建筑质量有问题?

不是， OC 需要所有的证书， STRAT PLAN可以在OC之前做， 但是OC 有时候会很慢， 比如说电工没收到钱，所以卡着电工证书不给， OC 就没办法拿。

如果顺利的话，申请oc后几天能审批下来啊？
