If you still think your tax information back in China is safe from ATO audit, you are so wrong.
For people who are still not aware, China joined JITSIC (the Joint International Tax Shelter Information Centre) on 16th September last year. Consequently, it means Chinese tax authorities have started to share their information with ATO.
ATO routinely exchanges information with its counterparts in countries under tax information exchange agreements (TIES). It also collaborates with its counterparts in several other countries through the Joint International Tax Shelter Information Centre (JITSIC) to tackle cross-border tax avoidance.
The JITSIC was established in April 2004, and currently comprises nine member countries (Australia, Canada, Japan, United Kingdom, United States of America, South Korea, China, France and Germany). The ATO has two representatives on JITSIC, one based in London and the other in Washington DC.
The JITSIC aims to assist in the identification, understanding and mitigation of risk arising from those who promote or take part in abusive tax schemes.
Key achievements to date have been:
deterring abusive tax arrangements on an international scale
intelligence sharing and joint audits between member countries (the ATO has commenced two joint audits with the USA)
exchanges of information (last year each delegate had in excess of 100 exchange of information requests)
building international relationships.
In some cases, ATO carries out joint audits with other tax administrations.
The rich sources of information available to ATO enables it to identify, for example, the employment-related foreign source income of Australian residents and match this with their tax returns (or identify those who have failed to lodge returns).
