there is an unwritten visa rule here.. for 676, one can only get 18months visa within 36 months period of time. your mum in law firstly came here in Jan 2009, so before feb 2012. she can only be granted max 18 months of 676 visa.
time has stayed in australia; first time: 6 months in 2009, 2nd time: 11 months from dec 2009 to nov 2010. there, theroatically, your mum in law can only be granted 676 visa for 1 month before feb 2012. you'd better apply after feb 2012, or you can also apply 1 month visa, there are chances that the immi will grant it and leave 8503 off the visa, in this case, your mum in law would have opportunity to apply a new 676 on shore.
the 18 months within 36 months rule is not in black and white, but immigration dept admit when to apply this only depends on visa officers decision. there are friends of ours had their parents came to visit them for two 12 months time over 36 months. this means, this is purely a bullshit rule, all depend on the officer's moody at the time |
