ATO Spouse的定义
Your spouse is another person (of the same or opposite sex):
to whom you are legally married, or
with whom you are in a relationship that is registered under a prescribed state or territory law, or
with whom you live on a genuine domestic basis as a couple
你们既然只是分居，法律上还没正式离婚，对方应该还算是你的spouse。即使他和别人同居，对方应该不是合法spouse因为已经有你是受法律保护的了
那就指定你的resident address和他的不一样就好了吧。也反映出你们分居的情况
