我们自2024年8月就一直month to month, 和中介签署了一份提前3个月通知就可以离开. 直到2025年9月中介提出加租12%并不能谈判, 我们马上email说无法接受只能离开, 但中介说有3个月通知期, 我们要按照新租金增加12%交租3个月, 但签收这3个月协议并没有提出新租金问题.
已经联系fair trading, 对方说只能通过Mediation仲裁解决, 但我需要支付$330, 这3个月12% 我们额外增加了1500刀, 请问是否有赢的机会? 是否值得花钱去仲裁? 我们上月按照旧租金交, 最后中介肯定在押金上扣.
The cost of formal mediation is $330 for up to 4 hours, per party. Additional fees (at $152 per hour) may be payable after 4 hours. These costs include GST.

It costs nothing for you to apply for mediation with the NSW Small Business Commission, and there are no costs for speaking to our office. If a mediator is appointed and a date agreed, each party will be asked to pay a share of the cost. Current costs are available online at www.smallbusiness.nsw.gov.au.

As part of the negotiations in August 2024, you advised that you did not wish to enter into a new lease agreement and instead requested to continue on a month-to-month basis. The Landlord agreed to this arrangement on the condition that a minimum of three months' written notice be provided prior to vacating the premises.
Please note that as a month-to-month tenant, all terms and conditions of the original lease executed in 2022 remain in full effect.
We draw your attention to the annexure clause contained within the executed lease, which outlines
Monthly Tenancy
“If the Lessee does not exercise any option to renew but, with the agreement of the Lessor, the Lessee continues to occupy the Premises after the Terminating Date, he or she must pay the market rent and will occupy the premises on the other terms of this lease, except that either party may end the tenancy at any time by giving one month’s notice to the other expiring on any date.
As mentioned to you in email dated 30.09.25 – have attached for your reference , we have advised that we will remove this invoice from our system., when all agreed |
