Under Migration Regulation 2.12L, a person is taken to be the legal personal representative of a payer if they provide satisfactory evidence to that effect. This evidence should be:
- A legal will or
- Letters of administration
If your mother did not have either of the documents listed above, a next of kin can request the refund by providing a completed Form 1424, the death certificate, statutory declarations by any other eligible next of kin supporting payment of the refund to the person claiming the refund.
Please submit Statutory Declarations (witnessed and signed by an authorised person) from the refund applicant and any beneficiaries under intestacy law (siblings, children etc) who are entitled to any of the estate of the decedent to indicate
1. their relationship to the decedent
2. that there is no will left by the decedent
3. the number of other siblings
4. their agreement to return the refund wholly to the bank account of original payer/ nominated account holder in the first instance.
5. Each statutory declaration made should be submitted together with identification document bearing name and signature of each declarant. Please provide a copy of their photo identification which includes their signature for verification purposes.
6. The mandatory legal requirement for statutory declaration to be provided are that either it needs to be on statutory declaration form or should it be made on the plain paper, the declaration needs to meet schedule 1 of the Statutory Declarations Regulations 2018 ( link for the same provided here for reference - :- Statutory Declarations Regulations 2018 (legislation.gov.au) ) |
