我和邻居2000年前是属于一块700m2的长方形土地, 2000年的时候被subdivision了,我是u1 他是u2 我的面积500m2 他的200m2,sewer main 和easement 都在他那一次,我今年拿到了building permit要开发两个小townhouse, 需要重新连接sewer main, 之前那条老的管线不能用了(根据最近的法律法规)。 plumber 联系了south east water,south east water说他们来负责帮我建sewer branch连接到在邻居前院的sewer main上。 但是需要我找邻居前permission for access to his front yard. 我现在还没有跟邻居提这个事情,心里比较忐忑,查了一些资料,我的理解是subdivision的第section12(2)赋予我权利使用在邻居地上的sewer line。
Section 12(2) of the Subdivision Act provides that there are implied into certain plans of subdivision, for the benefit of each lot and any common property, 'all easements and rights necessary to provide' the following:
passage or provision of water, sewerage, drainage, gas, electricity, garbage, air or any other service of whatever nature (including telephone, radio, television and data transmission);
rights of way;
Easements will be implied into a plan of subdivision to protect the rights enumerated in section 12(2) if they are both:
necessary for the reasonable use and enjoyment of the lot or the common property, and
consistent with the reasonable use and enjoyment of the other lots and the common property.
An easement 法律定义 is a right held by someone to use land belonging to someone else for a specific purpose. Common examples of easements are drainage, sewerage and carriageway easements.
在这种情况下,会出现几种情况
1。 邻居同意plumber进入他家施工,把地挖开,下管子,回填土地,修复地面。
2. 邻居refuse to give permission to give access to plumber to do the sewer connection work.
