Dear all,
Just looking from your valuable advice.
I live in the rapidly growing Melbourne West area. Due to our family circumstances, we decided to sell our property.
Needless to say, this is the first time which I'm selling property every done so before
We are started selling process during the lockdown. The REA agent tried to do everything in order to lower the price of our house and our expectation. He sends an email with the "compatible" property sales which was much worse than our house.
He provided incorrect information in order to sell our house quickly.
I do understanding that my huge mistake was to deal with this gay in the first place but again it was lack of experience. Nevertheless, he found a buyer for a minimum price which I was willing to sell and again this was during a lockdown.
We exchange a contract and the buyer paid a deposit when the contract becomes unconditional. REA agent immediately took full commission after the deposit was released to me.
Now my circumstances (I don't want to sell) and property market change rapidly after the lockdown I realised that I can sell at least 10% more. Now the question is anything I can do to cancel this contract I'm happy to pay the deposit back to the buyer and reimburse his expenses?
Looking into the contract of sale under default
If the contract ends by a default notice given by the purchaser:
(a) the purchaser must be repaid any money paid under the contract and be paid any interest and reasonable costs
payable under the contract; and
(b) all those amounts are a charge on the land until payment; and
(c) the purchaser may also recover any loss otherwise recoverable.
