NSW，Kone电梯公司黑合同，去哪告状

我们几户（基本都是华人）2009年和Kone电梯公司签订合同，十年期合同期满，那个月没注意没提退出，结果Kone电梯公司说，那就自动滚入下一个十年，我们如果2029前退出需要付好几万刀退出费。
我们有一份十多年前的旧合同（以strata方式和kone签过）。目前付电梯公司service费超过市价80%，几乎double。

足迹有人有经验么？去哪告状？fair trading没反应

有合同就按照合同来，要breach the contract也需要按照合同来。fair trading不接这种商业合同的case，找律师吧。

Example two: automatic rollover

A small business enters into a 12 month contract with an advertising company to manage its promotional activities. Despite the 12 month term of the contract, a term in the contract has the effect of automatically renewing the contract for a further 12 months unless the small business gives written notice that it does not wish to renew the contract at least six months before the initial term expires. Under the contract, the small business must pay a large fee if it wishes to terminate the contract early.

This term is likely to raise concerns as it allows the advertising company to automatically renew the contract without the small business’ express consent.

accc有保护小生意的法规。你可以仔细看看这个accc网站。
我之前也和一个倒垃圾公司有纠纷，他们的合同很多条都是accc提到的不公平条约。
我把他们举报了，但是没有什么大用，除非很多人都举报accc才可能accc帮忙出头。
不过我当时直接把这些链接发给倒垃圾公司，说我要解约，不行就走法律程序。他们自己理亏，就和我解约了

你要先通过ACCC给你提供法律意见并向双方调解，再决定要不要上庭提告。

"fair trading没反应”，什么意思？
也可去ACCC 咨询关于Unfair Contract Term-Price，是否可以终止合同。

顺便想问问收费是多少呢 我看了我们strata 2部电梯 一年是1万出头维护费

电梯看合同是不是comprehensive  contract.  跟多少层，几个电梯门，有无机房，有关。5-8层5000左右正常。有些小电梯公司很多东西不保修的，比如驱动。一个驱动要坏了就要一万左右了。楼主说fee over market 80%.如果是大的电梯公司给你报价不会差那么多20*%左右顶多. 小公司就不清楚了。很多东西用了就知道了

十几年前的合同，每年加8%。所以十几年后的叠加价格就很贵了！市面上随便quote一家，只有我们目前在付的约一半！
