business name一定要注册吗

一定要注册，相当于中国的营业执照。另外如果不注册的话是没办法开帐户的。

business name只意味着你拥有该名字的权力，那么你如果使用此名设立银行帐户，也许银行会让你出示该证书。

但是，它并不是营业执照，因为没有它你照旧可以营业（至少food shop没问题），比如take away food shop只需要持有council发的Food Certificate就可以开业了。

如果这个名字你不想被别人使用，那还是把这个名字注册了吧。

if you trading under your own name, (e.g david chen trading as david chen) then no,
it is a good idea to register especially if you have an very unique business name that you want to keep for yourself.

我的理解是必须注册的，相当于营业执照。以下段落摘自Consumer Affairs Vic的网站，也就是注册的地方，网址是

Why do I need to register a Business Name?
The Business Names Act 1962 requires the registration of the Business Name under which a business trades from a Victorian address. The purpose of registration is to provide a public registry of Business Names so that the identity of the owner(s) can be established and you can identify the person you are trading with.
Some organisations (e.g. banks) may also require proof of the registration of a Business Name before they will deal with a business, say in the case of opening an account.

Trading under an unregistered Business Name
What happens if a person is using a Business Name that is not registered? Can they be fined and if so what is the fine?
Subject to receiving proof of trading under the Business Name this office will contact the trader about the matter.
A penalty can be imposed by the court for using a Business Name that is not registered.

What do I do if someone is using a Business Name that’s not registered?
If someone is using a Business Name that is not currently registered you can write to this office and explain the situation and include proof of trading (for example by providing current fliers, invoices, photos, receipts, business cards, etc.).

business name 和 trading name是一样的，申请ABN的时候只问company name和trading name。如果是ABC Pty Ltd或者个人名字的话可以没有trading name，那么公司名字或者个人名字就成了trading name。如果想用一个其他的trading name，比如XYZ restaurant, 那么需要注册这个trading name，就变成了ABC Pty Lty trading as XYZ restaurant或者个人名字 trading as XYZ restaurant。

A business name is simply a name or title under which a person, or other legal entity, trades.
If the business structure you have chosen is as a sole trader, a partnership or a trust, and not as a company, then you are required to register your business name in the state or territory in which you will operate. But you don’t need to register a business name if you plan to conduct your business under your, or your partner’s, first name and surname.
If you are planning to set up your business in more than one state, you need to register your business name separately in each state.
Registration of a business name does not in itself give you any proprietary rights - only a trade mark can give you that kind of protection. Ensure you have exclusive use of your name now and in the future throughout Australia by registering a trade mark.

对。除了最后一个ccc pty ltd之外，这些都是trading name。那个ccc pty ltd就不同了，是company name，有ACN的，花费比较多，但是好处是有限责任，有资产保护。
