I along with Tony are owners of the business and I must say this is in 17 years of real estate the worst decision I have ever seen.
I cannot comprehend and don’t know what the member was thinking, the tenant didn’t even have physical evidence such as expert reports of heating technicians to prove his complaint or case. The member went off verbal we had the invoices and bills to demonstrate we had repaired this.
Not to mention I spoke to tenant yesterday and said why he would leave this until end of tenancy to complain like this and he basically told me he retaliated because we were taking him to VCAT for minor matters and decided to counter sue for the heating issues he suffered over his tenancy.
It is a very and absolutely disappointing outcome and there is options of appeal but this would mean you need to apply to the supreme court and both you and the tenant would need to hire a barrister and lawyer to appeal the outcome you may win but you wouldn’t get your money back for the barrister and lawyer you hire. It is a very disappointing position to be in to decide whether to appeal but I must say I don’t know what the member was thinking and we are awaiting his notes or his explanation to the members decision. You do have I believe 21 days to appeal at this point of time I cannot provide you with an opinion to appeal as the costs to you could be higher. But what I can say is it is my opinion the member got the decision wrong and I believe the tenant shouldn’t have been awarded anything or if that not anywhere near that much monies this is my opinion.
We await your response. In regards to legal advice you would need to have a lawyer whom specialises in VCAT and or real estate residential tenancies matters otherwise you will further waste your money. |
