The NSW Government will consider two options to stop unscrupulous developers from cancelling contracts on off-the plan apartment sales in order to resell the apartments at higher prices.
The move is a response to rash of recent cases where off-the-plan contracts have been rescinded by developers using sunset clauses which give either party the right to rescind if the strata plan not registered within a specified period.
The purchasers get their deposit back but without the profit they expected. Worse, in Sydney, they are back in the market, looking for a property after two years of boom.
The Minister for Innovation and Better Regulation, Victor Dominello, said there was significant concern about the way sunset clauses were being used to rescind off-the-plan contracts.
"Buying off the plan is becoming more and more common," he said. "Purchasing a property is a life-changing decision and we need to ensure consumers are protected against exploitative practices."
Under one option proposed by the government, only the purchaser, and not the developer, would be allowed to rescind an off-the-plan contract under a sunset clause.
The second option would be less prescriptive and more a disincentive for unscrupulous developers. .
In this case, if a developer terminated a contract under a sunset clause and resold the same apartment within a specified time, such as six months, the purchaser would be entitled to damages equal to the difference between the sale price on the two contracts.
NSW Fair Trading, along with NSW Land and Property Information, will put the options to a public consultation which closes on October 14.
Mr Dominello said one aim was to better understand the extent of the problem.
"We recognise that sunset clauses are an important contractual right for both buyers and developers," he said.
