能怎么样。可以选择告他们，一直理论，但是这样扰乱生活。还是MOVE ON,该干啥干啥，省得堵心。当然以告人为乐，觉得很有意思又不觉得堵心的当然可以一试。。

你只是指必须要经过对方同意才能录音的部分。还是后面的。。
前面是common sense 包括美国很多西方国家都是。 美国有的州则可以。
后面我记得足迹上有个法律工作的人发帖说的。 说只有在对方诬告的情况。才可以出具未经过对方同意的录音作为证据。

我不是学法律。  我说的未必都对。但是我觉得尽可能不要误导。  我们打任何的客服电话。第一时间会告知你被录音。你如果不同意。可以随时让客服删除录音记录。 所以必须经过同意才好录音。否则不能在法庭上采纳。就失去意义了。

楼主只要过了试用期你就是permanent employee啦.那个对话之后有没有让你签一个acknowledge letter,就是把谈话内容写在纸上然后一人一份那种?没有签字的东西你就不用担心啦.

Permanent employee要解雇很麻烦的,首先他要证明你能力有问题,或者有那些错误,把这些东西写入你的第一封offical warning letter.接下来employer还要证明他们有给过你机会并且留了足够的时间让你改正或者提高,比方把你送去什么training之类的. 如果单纯说你能力不行要解雇你,绝对是unfair dismiss. 到这里解雇你直接走ombudsman, 他们死定了

比方你继续有同样的问题,然后送你去了一个training以后情况并没有改变. 比方我这里从前有个阿婶脾气差,老和同事吵架,第一个警告信后就送她去anger management, 然后p用没用人家继续到处吵架.几个月之后当有同事投诉到management时候才可以出第二封信.

第二封信之后继续要证明雇主有通过其他的方式尝试解决这个事情,必须有再次给你机会并且留了足够的时间.还是阿婶的例子,我们授权她有不爽可以直接和MD说, 并且3天内还会为她召开夸部门会议. 这样又过了几个月,阿婶继续吵架....还是隔着电话跨州各种出言不逊,于是第三封信, significant misconduct,所以dismiss immediately. 她后来和我们打官司,也是我唯一赢了的官司.

回到楼主这里,你公司再小,要是不走这个流程将来有了纠纷他们必输,给你陪不少钱.哪怕你公司真的正规的走了上边的流程,估计你也要生孩子了,他们就不能开你了.

"42M. Making of direction for audio visual appearance

Refrenece:
(Evidence (Audio Visual and Audio Linking) Act
1997  Act No. 4/1997)

So evidence audio can be used as evidence in court. Counter part permission is not required.

        (c) as a consequence of a communication or publication of that record to that person in circumstances that do not constitute a contravention of this Part.

            (d)  is made to a person who has, or is, on reasonable grounds, by the person making the communication or publication, believed to have, such an interest in the private conversation as to make the communication or publication reasonable under the circumstances in which it is made, or

            (e)  is made by a person who used the listening device to record the private conversation pursuant to a warrant granted under Part 4 or pursuant to an authority granted by or under the Telecommunications (Interception) Act 1979 of the Commonwealth or any other law of the Commonwealth.

好像只有一种情况可以录音电话。   我没看懂怎么回事。好像说必须是第三方的设备？ 不能通过电话本身来。。  总之agument很大的。


The Law regarding the recording of Private Telephone Conversations

So, what is the law regarding the recording of private conversations in Victoria?

The answer depends on who is partaking in the “conversation” and what means are being used to record the same.

The position is this.  One can record a private telephone conversation without the consent of the other party to the conversation provided that the recording is not done through a device installed within the telephone.  This could for instance be an interception device.  However, it is permissible to record the private conversation via an external recording device such as a dictaphone or even some form of software installed on your computer (see Section 6(1) of The Surveillance Devices Act 1999 (Vic).

This is also confirmed in the Commonwealth Act (see Sections 6(1) and & 7(1) of the Telecommunications (Interception and Access) Act 1979 (Cth).

Note that, correspondingly, one cannot record private conversation of others!  A person must not knowingly install, use or maintain a listening device to overhear, record, monitor or listen to a private conversation to which the person is not a party, without the express or implied consent of each party to the conversation (see Section 6(1) of The Surveillance Devices Act 1999 (Vic).

我家两口子都在医疗系统，目前没遇到也没听说谁因此下岗。包括同公司的一个朋友刚生了孩子，并没有遇到任何麻烦。而且她从进来到休产假都没做到10个月。
我也许该强调一下医疗系统和其它公司不同吧！

大公司一般承受的了这个成本，也有基本的内部员工权益保障制度，不会去冒折损商誉的风险。你没在大公司工作过吧？

这是说国内么？澳洲哪家公司还发薪水啊， 估计也就银行这种给工资，普通公司都不给钱的

稍微有点常识的雇主都不敢轻易辞退怀孕员工

很多鬼佬这时候找茬偷懒不干活，雇主白养着也不敢辞退了，但凡有些纠纷认定责任在雇主都会被罚个底儿掉

建议楼主给FWA打个电话说明情况，留下个refer no以后就算有人为难你，你也有个记录
