Thanks very much for your time and patience listening to my lengthy story over the phone just now.
As I explained, we signed the initial building contract with Formula Homes on 16/September/2006. It took roughly one and a half years for the planning permit and the building permit be issued.
On the 4th April 2008, we received a notice letter from your company stating that the construction would commence on the 26th April 2008 and complete on the 10th February 2009.
On the 20th November 2008, we paid the full amount for the lock-up stage.
In January 2009, I discussed the construction progress with Brian, who then just took over our project. When asked the completion date, Brian said it would definitely be no way to complete before the due date which is 10th February 2009, but he would expect some time at the end of February. However, even the 2nd last stage, fixing stage was not completed until the 26th March 2009.
On the morning of the 26th March 2009, upon my request, Ravi, Brian, Phil and I had an on-site discussion. During that discussion, again I requested a date for completion and expressed my urgency of having the construction completed. Phil promised it would be at most six weeks. On spot Ravi also urged Phil to try to finish within four weeks from that date. Although after six weeks, there had been not much work scheduled at all.
On the 11th May 2009, I had another on-site discussion with Phil in regard to electricity cabling. A street tree needed to be pruned to give way for electricity cables. Once again, I asked the completion date. Phil said once the tree was pruned, there would be only 2 days for him to complete the project.
I organized the Council to prune the tree on the next day, 12th May 2009 and notified Phil the status on the same day. I have never heard from him since then.
On the 17th May 2009, I learnt that Brian took over my project again. By this time, the construction had already been overdued for more than 3 months.
Brian said he was shocked to learn that our project still not complete and promised that he would complete the construction in 2 weeks. He also promised our project would be the highest priority in his work list.
In early June 2009, since I had not noticed many apparent changes on our site, I requested an on-site discussion with Brian. Brian guaranteed me that everything had been under control and the 19th June 2009 would be the ultimate completion date.
On the 19th June 2009, I went to the site and found things looked almost the same as two weeks ago.
On the 14th July 2009, I called Brian to request an update. He said the completion date would be Friday the 17th July 2009.
On the late afternoon of the next day, the 15th July 2009, I went to the site and shockingly found not one single piece of work had ever been organized since early June.
I called Brian that evening and left a message to him, that our project has been overdued for nearly 6 months, yet I cannot see a sign of completion. Why cannot two-weeks-workload be completed for more than four months? I asked Brian to call me back but have never heard back from him.
On Friday the 17th July 2009, I went to the site at 6:30pm, with no surprise, things are just the same as what they were four months ago.
I then called Brian. Again my call was not answered. I had no other choice but left another message to him, that I requested a meeting for Ravi, him and me. I have not heard from him till now.
Nowadays our construction has been overdued for nearly 6 months. This is my last attempt to coordinate such endless pains with your company on my own. The incredibly delay of the construction and the ignorance of me as a client have already caused enormous loss to me and my family, both financially and psychologically. If I cannot foresee any satisfactory results before COB today, I will not hesitate one single bit to seek legal assistance to claim my rights.
