In this case, you need to find out whether there is an easement over the existing public stormwater main (the one on your side which the neighbour has proposed to connect into.
If there is an easement on the title and in favour of the Council or the neighbouring land, the neighbour has the right to install a connection by installing a pit on your land to the satisfaction of the Council, with or without your consent. Note that to minimise the impact on your land, you may wish to discuss with the neighbour/council asking for a junction (OB), instead of a pit, subject to the main size and council approval.
If there is not an easement on the title, the neighbour needs your consent, prior to making the connection. However, it is worth to note that despite the neighbour may not have the right to entering your property and making the connection, the Council has the power under relevant legislation to enter the property and make the connection (installing the pit) by issuing the land owner a notice in advance, if it is deemed to be necessary. |
