(1) Once you have signed and returned the Section 27 Statement for release, your deposit monies will be released to the Vendor immediately.
(2)If you do not want the deposit released to the vendor now, you may sign later on. However, you cannot lodge an objection as the there are no caveats or mortgages lodged against the title (clear title). In this case, if we do not receive the fully signed statement from you within 28 days, the Vendor will automatically have access to your deposit monies thereafter.
楼主啊,这是很正常的条款啊,是从维州房产法律里的Section 27来的:
这条Section 27在法律上是专门为那种卖了房子、但没有现金去做为购买下一栋房子定金的情况设计的。
当然,对于settlement之前release deposit专门的条款Section 27来说,一般需要满足以下几条:
1)没有caveat(房产买卖不受任何其他人影响);
2)剩余未还清贷款不能超过房价80%;
3)不能用这个房产再进行抵押贷款。
只要满足这3条,买方通常没有理由拒绝,但是即便买方拒绝,那么在卖方律师发section 27 statement给买方的28天后,屋主的律师依然可以通知中介自动提前解冻10%定金。
如果以上3个条件不满足,那可能直接通过你的方律师驳回,那么屋主只能等到settlement交割日当天才能拿到定金。
