My Full name is Richard ***. I am a Senior Constable with Tasmania Police,currently stationed at the ***police station.
I am a qualified operator of BEE III mobile radar, having undertaken a training course during my employment. I have previously been attached to traffic services for over 7 years and have extensively used mobile radar. I routinely check the accuracy and serviceability of the radars using tuning forks, provided by the manufacturer.
On Thursday the 27th of October 2017 I was on duty with Constable Ben *** and conducting mobile patrols in a marked police vehicle, conducting mobile speed checks on the ***Highway. At 2:45 pm, I observed a white Mitsubishi Mazda MX5, registration E***A,travelling northbound from the *** Road area through the North West Bay River dip. I observed the vehicle was travelling at speed. Our vehicle's mobile radar,MK08,indictated that the vehicle's speed was 130 kilometres per hour. The Mazda was a single vehicle target at the time of detection and the radar for certified for use. I tender a copy of that certificate.
After the vehicle passed, I turned the police vehicle and followed the Mazda, activating our vehicles emergency lights and siren in an attempt to inercept it. The Mazda pulled over approaching *** Road.
I spoke with the driver and single occupant of the vehicle, *** the defendant, who identified himself by a photographic driver licence. The defendant held a current Provisional 1 driver licence.
The defendant stated to me that"The hill was too sharp and I couldn't stop." I invited the defendant to view the radar speed reading in my vehicle, however he declined. After the intercept,I checked the preceding speed limit signs, which were clearly visible.
On Tuesday the 19th of September 2017, I photographed the last speed limit sign the defendant would have passed prior to being detected speeding. This sign is located approximately 350 metres prior to where I detected his vehicle.
At the time of the offence the weather was fine, the road was dry, traffic flow was moderate and there were no passengers in the defendant's vehicle. The *** Highway is a road in the municipality of *** in Tasmania. |
