'No DNA' to link accused murderer to family massacre site

POLICE have failed to find DNA linking accused murderer Robert Xie to the scene of the Lin family massacre in Sydney in 2009, with the crown case instead relying on recorded conversations that suggested family "jealousy" as the motive for the killings.
Mr Xie, who is accused of killing his brother-in-law, Sydney newsagent owner Min Lin; his wife, Yun Li "Lilly" Lin; their two children, who cannot be named for legal reasons; and Lilly's sister Yun Bin "Irene" Lin yesterday applied for bail in the NSW Supreme Court.
The five Lin family members were bludgeoned to death in their North Epping home, in northwest Sydney, on July 18, 2009.

The court was yesterday told conversations between Mr Xie and his wife, Cathy, in early 2010 showed there was "friction" in the family, even though Detective Sergeant Joseph Maree - who led the investigation - conceded the police probe had found Mr Xie was not a violent man and the Lin family was "loving and close".
Defence barrister Graham Turnbull SC told the bail hearing the prosecution's case was "extremely weak" because they had failed to establish a DNA link between Mr Xie and the crime scene, nor had they uncovered a motive for the killings.
"There was in fact no DNA from the applicant (Mr Xie) found on any items taken by police from the crime scene . . . nor any of the victims' DNA found on any of his items or his property," Mr Turnbull said.
The court heard police took DNA from the power switch at the Lin home, which was turned off on the night of the killings, but the sample had remained "unidentified".
Mr Turnbull said it was clear there was no financial motive for the murders - a claim agreed to by Sergeant Maree - and he said the crown "cannot point to a word that points to a motive or any previous animosity between the family".
"There is no passion. For the passion of killing his sons' cousins, there would have to be a very, very powerful motive. We actually say there is a motive not to do it," Mr Turnbull said. "(There is) no evidence of any statement by the applicant that could be seen as expressing any hatred."
Crown prosecutor Kara Shead told the court a swab of blood found inside the garage of Mr Xie, which contained DNA from Min Lin and his two boys, would play a large role in the prosecution's case.
She said Mr Xie owned several pairs of Asics runners with tread that resembled bloodied footprints from the scene of the crime. Mr Xie was later secretly filmed destroying boxes for the shoes.
Ms Shead opposed the bail application, telling the court Mr Xie had significant funds and real estate in China, and was therefore a flight risk.
