Background
准备买楼花（off-the-plan), 要交initial 10% deposit, 我跟开发商提议要自己做bank guarantee, 然后开发商发instruction过来，其中有一条是“The Bank Guarantee must be unconditional and irrevocable and payable on demand by the Bank at the request of the vendor’s legal practitioner without reference to the purchaser.”
我觉得这个条款很不合理，因为我对bank guarantee的理解是10% deposit是被银行冻结，直到settlement的时候才能被release出来。 在我跟开发商及其律师交涉之前，想请教一下论坛的各位有办过bank guarantee对此的观点和看法。 Many thanks in advance. |
