[修房建房] pc建房 何时能够退印花税 [复制链接]

我是PC 买地建房,现在房子快建好了。考虑到我是首次买房,所以应该能够免印花税,但是当初买地的时候,我是交了5000多的印花税的,当时律师说等你建好房后才能refund. 请问有经验的童鞋,怎样才能和政府要回这笔印花税,可以自己要还是必须通过律师??

If you buy a block of land and sign a contract for the construction of a house
on it, you pay stamp duty on the land alone.
Builders often include in the Contract of Sale a special condition that certifies
the value of the land at the date of sale for stamp duty assessment purposes.
The same method can be used for selling partly constructed houses or units.
That is, a special condition in the Contract can give the value of the property
at the time of signing. Stamp duty is paid on that value and not the whole
Contract price.

However, from what you have said, it seems it was not the case in your contract.  You can apply for a refund with SRO either by yourself or with the assistance of your solicitor (pending on whether you need to pay extra fee as I dont know the service coverage provided by your solicitor).

地的印花税只是有折扣,没听说能全免。所谓的refund应该只是折扣。你最好再问问你的律师

If you are buying or have bought a property as your PPR and you are a first home owner you may have access to the First Home Owner Grant (FHOG) of $7000. If you are eligible to receive the Grant, you may also be entitled to receive an additional payment of  $13,000 (for new homes only), known as the First Home Bonus (the Bonus). To be eligible to receive the Bonus, the purchase price of the property must not exceed $600,000.

(I doubt you would be entitled to the bonus, as usually the purchase price of the property would have exceeded $600k?)

However, as the Duties Act 2000 does not allow you to receive both the Bonus and the PPR concession; you must elect to receive one or the other. It is in your favour to elect to receive the Bonus as it is worth more than the PPR concession. If you do elect to receive the PPR concession, you must repay the difference between the Bonus and the PPR concession.

As LZ has only paid $5000 for the SD, it looks like it being paid on the land value only (which means you have already enjoyed the concession)?  Not sure whether you are talking about the right numbers.

Maybe LZ can clarify.

谢谢。那也就是说我买地能够享受stamp duty 的折扣,我按照SRO的算法也就折扣了几百块钱,本来以为可以像买现房那样全部免费呢,白激动了。

The concession is up to $2870 (if i got the $ right).  I think your land is far below $550k.  Thats why you only enjoyed a few hundreds off.
