Council, under the powers conferred on it by Section 9.35(1)(b) of the Environmental
Planning and Assessment Act 1979 (the Act), orders you as the owners of the building,
to take the actions specified in the terms of the order set out below, within the time
period set out below, and for the reasons set out below.
Circumstances:
An inspection of the premises carried out by an authorised Council Officer on
Wednesday 10 May 2023, and Monday 29 May 2023 has revealed
unauthorised contruction works consisting of:
• A verandah adjoining the secondary dwelling and within 900mm of the
northern lot boundary.
• A carport and garden shed within 900mm of the western lot boundary.
• A verandah adjoining the rear of the primary dwelling and within 900mm
of the northern boundary.
A search of Council records revealed no evidence of a development consent,
construction certificate or any other form of consent for the construction work.
The construction work does not comply with the development standards as
setout in the State Environmental Planning Policy (Exempt and Complying
Development Codes) 2008 and is therefore considered unauthorised.
Terms of the Order
DEVELOPMENT CONTROL ORDER
Pursuant to Section 9.35(1)(b) of the Environmental Planning and
Assessment Act 1979 (NSW)
1. To demolish and remove the verandah in the rear yard, adjoining the
secondary dwelling (see attached photograph), including all associated
fixtures and fittings.
2. To demolish and remove the verandah in the rear yard, adjoining the
primary dwelling, including all associated fixtures and fittings.
3. To demolish and remove the garden shed, in the rear yard along the
western lot boundary, including all associated fixtures and fittings.
4. To demolish and remove the carport, in the rear yard along the western
lot boundary, including all associated fixtures and fittings.
5. Work associated with this Order must only be carried out between the
hours of 7:00am and 5:00pm on Mondays to Fridays, inclusive and
08:00am and 3:00pm on Saturdays and no work must be carried out on
Sundays or public holidays.
