Of the 129 murderers jailed in the past five years, only five were jailed for less than Caratozzolo and eight others were given the same, a 10-year non-parole period.

The average non-parole period for murderers was 16 years.

杀人犯的平均不可假释刑期是16年,而此罪犯的刑期只有10年。

A 10-year jail term given to the ringleader of a gang who kicked a man to death for fun has sparked a wave of public anger.

The Director of Public Prosecutions is reviewing the sentence given to John Caratozzolo for the murder of Dr Zhongjun Cao.

Caratozzolo and six others bashed and kicked the 41-year-old academic in a Footscray street as he walked home from Victoria University in January last year.

Caratozzolo was jailed for 15 years with a minimum of 10.

Only five of the 129 murderers jailed in the past five years have received a lighter minimum sentence.

Victims' groups said they were disgusted by the sentence and more than 300 people felt moved to comment on heraldsun.com.au.

Dr Cao's widow, Jingfang Zhou, said her family had been destroyed and she had lost the light of her life, a man she had fallen in love with at first sight.

"We were not two people, just one," she said.

"How much does my husband's life deserve?"

The gang of youths planned to go "curry bashing" and rob an Indian student for a mobile phone.

Instead they came across Dr Cao, a gentle and beloved father who stood no chance against seven young men.

He was not even asked for his phone before the beating began. One of the thugs picked him up and dropped him on his head.

As Dr Cao lay dying, Caratozzolo laughed and delivered a vicious kick to his victim's head as a parting gesture.

The gang then moved on to its next target, Bhinesh Mosaheb. He was bashed and robbed and now suffers from a twisted spinal cord.

Justice Harper said Caratozzolo was a "laughing assassin" whose racially-based violence scarred the community.

"Crime based upon racism is a negation of Australia's fundamental values," he said.

Caratozzolo, now 21, pleaded guilty to murder and robbery.

Justice Harper said he took into account Caratozzolo's age, his immaturity, his guilty plea and his good prospects of rehabilitation.

Of the 129 murderers jailed in the past five years, only five were jailed for less than Caratozzolo and eight others were given the same, a 10-year non-parole period.

The average non-parole period for murderers was 16 years.

DPP Jeremy Rapke, QC, will consider an appeal against Caratozzolo's sentence.

"I will announce my decision as soon as I have completed my review," Mr Rapke said.

Crime Victims Support Association president Noel McNamara called the sentence a disgrace that would add to the pain of Dr Cao's widow and 16-year-old daughter.

Dr Cao's family and the Chinese community have called on the public to protest over the sentences given to other members of the gang.

Several were sentenced to youth detention last year.

They intend to ask the Director of Public Prosecutions to appeal the sentence of 15 years, with a minimum of 10, given to John Caratozzolo, the ringleader of seven youths who bashed and kicked
Dr Zhongjun Cao to death in a Footscray street in January last year.

Victims' advocates claimed the sentence for Caratozzolo, 20, whom Supreme Court Justice David Harper described as "a laughing murderer'', was manifestly inadequate and out of touch with community expectations.

"If John Brumby thinks he has problems with the Indian community, wait until he sees the reaction of the Chinese community to this sentence,'' said Steve Medcraft, of People Against Lenient Sentencing.

"These thugs went out to bash an Indian and when they couldn't find one, they picked on a Chinese person instead

"I find it amazing that someone with a record of extreme violence, which Caratozzolo had, could get such an inadequate sentence, even if he did plead guilty.

"It is time for the judiciary to be held accountable and for sentencing to reflect the horror and disgust of the community over crimes like this one.''

The court heard the gang kicked the gentle Victoria University researcher to death for fun while out "curry bashing" to get a new mobile phone has been jailed.

Caratozzolo laughed after inflicting a vicious kick to the head of his prone and dying victim.

Dr Cao, 41, was set upon and killed he walked home from Victoria University in Footscray in January last year.

Justice Harper said Caratozzolo, 20, suggested to his mates that they go "curry bashing" - meaning targeting and robbing Indians - because he needed a new mobile phone.

But when they saw Dr Cao walking alone the group attacked him without warning, assaulting him "for pleasure" without even asking for his phone.

One of the group dropped Dr Cao on his head during the attack and as he lay badly injured.

Caratozzolo launched a kick at his head as a parting gesture.

"You have become a laughing murderer," Justice Harper said.

After the fatal bashing the group went on to attack another man, an Indian student.

Dr Cao's widow Jingfang Zhou spoke of her love for her husband and the void his death had left in the lives of herself and their teenage daughter.

Justice Harper said Caratozzolo's racially-motiviated actions struck at the heart of the entire nation.
"Everyone in this city, in this state, and in this country - everyone whatever their gender, race or beliefs, has the right to walk the streets without fear," he said.

"You have diminshed the quality of life of us all."

Caratozzolo pleaded guilty to murder and robbery and was jailed for 15 years with a minimum of 10 years.

But Victims Support Group president Noel McNamara called the sentence a "disgrace'' which he believed would add to the pain of Dr Cao's widow and young daughter.

Chinese community leader Wellington Lee said the courts were not reflecting public expectations.

"What is a life worth?'' he asked.

"This is far too low a sentence for such a brutal act of thuggery and it sends the wrong message to the wider community.

"This was a defenceless man, an innocent victim. It has had devastating repurcussions for his family.''

Mr Lee, a JP who has sat on the bench and is a former member of the Parole Board, said he would favour an appeal to the DPP if legally possible.

这个是立法而不是司法的问题了,法官判刑已经是法律的规定上限了

此案犯无主观杀人动机,跟一般的murder还是有区别的。
法官在量刑上肯定是有类似的考量因素在内。

印象中此罪犯最后是选择认罪而没有等待陪审团判罪

应该是以认罪换取较轻处罚。

not commenting the verdict itself, but I am quite pleased to see that the court is sending out a strong message to the community:

"Everyone in this city, in this state, and in this country — visitors, students, residents, everyone, whatever their race or gender or beliefs — has the right to walk its streets without fear. This is a fundamental right, one which all of us are entitled to take for granted. It is a necessary element of any decent community. You have flouted that right,’’

‘‘You have added to the level of community fear, and fear is a particularly corrosive force. You have therefore diminished the quality of life of us all. You must pay the price.’’


and indeed, the barrister is considering taking an appeal against this "extrodinarily low" sentence.

请问“无主观杀人动机”是什么意思? 为什么比一般Muder要轻而不是重?

如果是双方有争执,而引发的愤怒而杀人, 这是有动机的吗? 我觉得是有个原因的,起码他只杀和他有私人怨恨的人,不会去杀和他无关的人。
而现在这个杀人犯, 因为喜欢杀人取乐和种族仇恨, 这是不是有动机杀人? 注意:他可能去杀任何一个人,并认为这是很有乐趣的事情。
相比之下,你认为哪个危害更大?
我不明白你说的“主观动机”是什么, 但是从对他人的危害来说, 后者要比前者严重得多,因为前者只杀让他怨恨的人,而后者可以去杀任何无辜的人,而且他不是一下杀死,而是在折磨杀人的过程中获得快乐和满足感。

无主观杀人动机,顾名思义就是他本来不是想杀人的,主观上是伤害对方而不是将对方杀死。
你非要说他是无目的的随意杀人,这跟案情不符。
辩论这个不如看看法律条款看看怎么定义的,我也说的不算。
法官比你我都更懂法。

为什么你说这已经是法律规定的法官能判的上限了? 这么说的来源是什么?
你是否注意到其他的杀人犯绝大多数都比这个判的年数多?
你是否注意到OPP说要Review这个案件,因为判得轻,有可能重新起诉?

法官的判决要依照法律和惯例,需要避免的是受到媒体的影响。
法官指责该犯的种族仇恨,是因为法官认为这个杀人案件是种族问题。不是先前说的不是种族问题,是单个案件。
如果是种族仇恨,这样的案件以后发生的可能性会很高。

印象中此罪犯最后是选择认罪而没有等待陪审团判罪
应该是以认罪换取较轻处罚。

我认同这是惟一能让从轻量刑的借口。其他法官说的年轻,我并不认同,因为他当时已经20岁,现在21了,任何时候都是成年人,就不应该有年龄借口。
说他的自新我也并不相信,因为种族仇恨不是一天就可以自新的,他的认罪只是为了换取减刑而已。
可是话说回来,即使他不认罪,他有多大的可能性逃脱有罪判罚?几乎是不可能的。所以,他承认有罪是一个对审判没有太大意义而只对罪犯本身有用的行为。

我现在的理解你说的无主观动机意思是过失杀人,否则任何一个人杀了人都可以说我不是故意的,我用枪只是想吓唬他,结果枪走火了,我用棒子只是想伤害他,没想到一下子打死了。等等。。。。

我没有说他是无目的的杀人, 我只是引用法官说的,他是基于种族仇恨和取乐来杀人,这种杀人的目标可能是任何人。
法官是比你我更懂法,但是我们还是要讨论的,否则, 报纸上也不用写“有人愤怒了。。。,OPP也不用再Review,看是否需要再上诉了。

比我预计的要好。。。十几年前有个家伙把自己怀孕的妻子干掉,只关了12年就放出来了。

还有一个更夸张,一个教唆犯,一个主犯(前者的儿子,开枪的那位),一个从犯(旁观加协从),共同杀人,前两个(就因为他们是名人,好像是重量级拳击冠军什么的,反正是搞体育的)被放了,后一个关了N年。。。这个可是陪审团的决定喔。。。所以即使民主社会也不见得是公平社会。

我觉得,那个杀了他妻子的人,就是他和他妻子有个人恩怨,他杀他妻子是有原因的,他不会因为这个原因再去杀其他任何人了。
曹博士这个主犯,杀人是没有直接原因的, 法官认为的原因是: 种族仇恨和取乐。 那么因为这个原因,他可能以后去杀任何一个无辜的人。所以我觉得该主犯应该被叛得更重才合理。

越来越觉得陪审团制度不那么合理, 试问有多少人愿意参加陪审团? 我周围的白人我还没有遇到一个喜欢参与这个的,被抽中了,不得不去吧。
这个主观上都很讨厌的事情,去了以后怎么可能很自豪地把这个当成一种权利或者义务去履行呢?怎么可能去支持公正和公议呢?随机地抽这么些不懂法律的人(现在好像法律工作者还是不可以参与陪审团的)落在某一个群体里的可能性太大了。就像薛乃印的陪审团,居然全是女的(为啥不选全是男的啊?)。

我想这个家伙被判12年的时候,法官估计和您一个想法。。。所以才判了12年。。。您还是很有当法官的潜质的。至少也算英雄所见略同。。。我就不行了,我实在见不得一枪干掉自己老婆的家伙,换我是法官,一定判他自己拿个枪对准脑袋来那么一下。

民主社会就是分歧大啊,人人有话说,你看我俩意见差距都那么大,照谁说的办都不公平啊。。。所以这年头谁嗓门大,正确到舆论才是关键。。。嗓门小就能认了。。。

陪审团的任务是定是否有罪,法官任务是量刑。

这个罪犯已经认罪,所以就不用陪审团了。省了不少钱。

这次的判罚应该算是比较公正了,能判成15年,已经很不容易了。可能因为是团体作案,等于刑期被几个人分了。尽管很多人希望这个杀人犯被判无期。

现在看来,华人团结在一起的作用是很大的,这个是主因。 这种团体案子中的个人在中国能被判到这个刑期也算不错了。

而且这个案子的大背景正好是澳洲政府要和印度搞好关系,解决国际留学生频繁被袭的问题,我想这个案子能这样判多多少少和这个有关。

楼上搞混淆了吧,之前被判2年的是从犯而已。
他们的罪行是对曹脸上打了一拳推了一把。
这个是主犯,他的踢打造成致命的伤害,不存在2年刑期改判到15年。
