紧急求援： 澳洲父母143签证碰到麻烦了

各位新足迹的朋友，我在2011年6月提交了我母亲的143申请，因为父亲已经过世所以想让母亲尽早过来。



今天收到移民官的邮件说我在申请前没有在澳大利亚住满两年，所以要在28天内提供有效的文件或证明。



我的情况是这样的：

1. 我在2004 1月来到澳大利亚读书，在2006年3月底拿到PR后6月就回国工作了。一直到2010年1月份才会来。

2.自从2010年1月以后一直没有离开过澳洲，期间在2011年6月份提交的我母亲的申请。在申请前我也两次打电话到移民局问过我的这种情况能不能申请，当时电话里移民官说是可以的。

3. 我在2012年2月份延期了PR 5年，到移民官正是处理我母亲的申请时我已经住满2年半了。而且我在2012年3月在悉尼已经结婚，工作也很稳定。



我想问一下，像我这样的情况有没有办法能够让移民官不拒绝呢？有哪些文件或理由可以申诉呢？

你申请时到底有没有住满2年呢？当时你咨询移民局时有没有email证明，有的话把email交上去就可以了

申请的时候lz在澳洲以pr居住了1年半，不够两年。

withdraw，就不会被拒签了。

如果要提交材料证明当时申请的急迫性，请保证材料务必是真实的。

慎重的做出选择。

这个“在28天内提供有效的文件或证明”是用来证明什么的？？？

记得当初申请是留学时间也算的。email问问是不是移民局弄错了你的出入境记录啊。要么亲自去移民局打印一下出入境记录就清楚了。

我找到这个，不知道有没有用。
作为父母签证担保人在澳洲成为定居居民的新要求：于2012年3月29日举行的MIA研讨会中移民官就父母签证作出宣布移民局正在衡量作为澳大利亚定居居民的担保人的新定义。欲满足作为澳洲定居居民，澳大利亚永久居民必须在澳大利亚居留至少2年。居留签证包括任何实质性签证包括任何永居签证，学生签证，457签证和过桥签证A,B,C,D和E.目前担保人在澳大利亚的2年居住是签证申请的条件，并且不是在签证决定时的条件，而是在签证递交时的条件。居住在海外的澳大利亚公民返回澳大利亚，须在澳大利亚居住至少3个月才可符合作为’定居居民的条件。

　　这珀斯父母签证中心的新主管颁布的新条例是与前任退休的主管的陈述不一致：在之前，移民局也可以考虑那些刚刚移民澳大利亚，并已经在澳大利亚的稳定工作的的新永居居民，作为定居居民的资格。这是由于签证决定时间须等待18个月。到那时候，申请人已能付合2年定居居民的定义。可惜的是，这旧政策已不作准。新官三把火，现在一切照新新条例进行。

每个人对政策和规定的理解是不一样的，你还是和case officer交流一下所谓“2年的”具体算法。可能你2006之前的两年不算在最近的5年里。

2年指的是持有pr在澳洲居住两年

这就和如果你要申请centrelink的福利一样的
都是持有pr居住2年
如果留学都算的话，大多数留学生一拿到pr都有这个资格帮父母担保143了

不会把,我10年拿到pr ,11年申请父母,现在已经分到co了,根本没提我这个有问题啊,之前留学时间算得,我是毕业后直接申请pr的,一直没长期离开澳洲

个人认为,新定义是在你提交申请后才出的,你当时递交的时候是符合当时政策的,所以没有问题.不然你也不会提交了.

你先跟co申请,你当时申请时,这个新定义还没有出来呢!!说不定是个新co, 所以不了解情况,按照当下政策来的

你要是withdraw再交,损失的差不多1万刀啊!涨价加上损失的和重交的第一笔申请费.

这个是移民局官网上面下载的1129-Parent Visa- booklet3里面关于settled的定义（12年4月版）：
Page18--Settled and usually resident
To be eligible to sponsor you, your sponsor must be able to show that they are settled and, that they are usually resident in Australia.
Settled means that your Australian citizen, Australian permanent residents or eligible New Zealand citizen sponsor must have been lawfully resident in Australia for a reasonable period. Under policy, 2 years is generally considered to be a reasonable period. There may be exceptions, however, and the facts of each case are considered on an individual basis by the offi cer of the department who is making the decision,
particularly if there have been periods of lawful temporary residence that can appropriately be counted towards the settled requirement.
A shorter period of lawful residence may be considered for Australian citizens for settled purposes if there are compassionate and compelling circumstances. As a matter of policy, the eligibility period for Australian citizen sponsors in such circumstances is at least 3 months’ residence.

关键的一句Settled means that your Australian citizen, Australian permanent residents or eligible New Zealand citizen sponsor must have been lawfully resident in Australia for a reasonable period.

这句话里面移民局并没有死抠一定要是获得pr之后在澳境内居住2年。只是说这个担保人要是公民，pr或者新西兰公民其中一种。而且这个个人必须已经在澳境内合法居住了2年。没有强调说这个人一定as a citizen or pr的情况下居住两年啊。

我的情况和LZ几乎一样，爸爸过世，办妈妈。如果不算留学我的2年差好远，所以希望楼主可以获签，也给我们在你后面排队的人希望。

个人理解实质上还是要证明在递交和处理申请时已经settle，lz并没有讲明被要求补哪方面的资料，是要证明居住时间还是要证明settle状况，因为即使以前在澳洲长住也可能发生递交前没有settle的情况，最好能把具体要求贴一下。估计很可能是之前那段长期在澳洲境外的时间导致被认为之前的居住没有settle，然后又不满足递交申请前两年主要居住在澳洲，所以被要求补能证明递交申请时已经settle的材料。lz发过这个帖子就没再出现过了？

常住但是没有seettled的状态？可以举例吗？

比如在澳洲住了几年，但是后来搬家去海外了，又过了好几年搬回澳洲了，不就等于要重新settle了么

最好就是打电话到移民局去问问怎么算的，最保险了。然后再看看自己填的表格有没有笔误。

我是06年1月来留学，10年5月拿到的pr，然后10年12月帮我妈妈申请的143，然后12年3月就很顺利的下签了。移民官没有发消息说我的父母移民申请不eligiable.所以我觉得2年的时候应该是包括在澳洲学习的那些年的.

LS的其实属于很典型的一个澳洲留学生自己拿PR后，再申请父母143的例子。相信绝大多数人都走的是这样的路。只不过，我和lz一样，都在拿到澳洲的PR后不久，就离开了澳洲一段日子（LZ离开大约4年多，我离开了1年8个月SO FAR）

可能像我和lz这样的情况，比较容易引起co的注意，从而刁难。。。。因为我们没有乖乖的Settled in OZ
