4月份那个风雨交加的夜晚，从kerb side出车被后边开过来的车给撞了。自然是我全责。让人震惊的是，我竟然没有买保险（忘记renew)了。。
反复回想，貌似那人没有开灯，当然也没有什么证据。庆幸的是那只是一辆06年的马三。。。
接到保险公司的账单，竟然要我赔$14000。整个人顿时都不好了。
我们contact 了Financial Ombudsman Service Australia， 这是和fair trading 一样类型的机构，有专门给insurance dispute提供建议的机构，他们给了我们advise，就是三个字：要装穷！！ 并且要直接contact该insurance公司的claim部门，而不要和给你发信的小兵废话。
于是我们给他们发了信如下：
To whom it may concern in xxxx insurance dispute team, regarding xxxxx case:
1. After discussing with Insurance law service and experienced professional legal organization, we do not accept your judgment towards my insurance claim decision especially when we have financial hardship.
2. Even if we are holding 100% responsibility; we will pay no more than the PAV value of the car minus the sold value which is under $8500 in instalment which was also agreed with xxxx staff through the phone.
3. We are suffering financial difficulties at this stage, we have new born baby to raise and heavy mortgage to pay, also our parents are counting on us, and therefore we are not going to settle this ridiculous and unfair amount for our family unless we have reasonable treatment.
4. As discussed with professional legal organization, and past cases on court, which non fault driver did not turn on the lights in night driving, we do not agree that we are holding 100% responsibility in this case, principally due to the extreme hazard weather condition in that day (20th April to 22nd April), plus we have more evidence and witness which can show to the court besides parts of evidence we provided to xxxx insurance if we have to goes on court to solve this unless this matter can solve prior.
5. We request response in 45 days, or FOS is willing to further involve in this disputation.
很快，该公司的负责人call me,态度非常好。说这样吧，原来让你付14000，现在只要付8200，你看怎么样。
我想了想说，8200还是太贵。
他说，你现在上班吗。我说当然上班，但不是月入million那种。他表示非常理解，说8200的确太多了，没有谁能一次性付这么多cash。这样吧。我给你50%discount,你付我4000就可以结束这个case.
我说不然就3000吧，我今天就可以给你你看怎样。
那人毫不犹豫的说：好吧。。。。。。。。
我实在想捶自己应该说2000。。。
于是我们收到信如下
2. Reduced settlement payment
Whilst we maintain our position that the cost of the damage to our customer’s vehicle is as stated above, acting in
good faith and in a genuine interest to resolve this matter we offer to settle for a reduced amount of $3000.00 if it
is paid by August 18, 2015.
于是这个case就settle了。

当然，我们现在已经买了保险，不想再节外生枝了。 |
