Notice for Professional Year Providers
Compressed program arrangements
On 11 November 2010, the Minister for Immigration and Citizenship, the Hon Chris Bowen MP, announced that the Government would implement a new points test for certain skilled migration visas from 1 July 2011.
The Department of Immigration and Citizenship has received a number of enquiries from students and Professional Year (PY) providers with students participating in a PY on 11 November 2010 who will be unable to provide evidence of completion of their PY before the commencement of the new points test on 1 July 2011.
Specifically for this small group of students, the Department will agree to a compressed PY program which would allow them to complete their PY in time to lodge an application for skilled migration before 1 July 2011. However, any compressed PY program must not compromise on the quality of the professional program.
Providers can choose to opt in to deliver a compressed program, subject to agreement from their PY peak bodies. If providers choose to offer a compressed program, affected students can be given the option of choosing to proceed with their current course or undertake the compressed course.
This arrangement is available only to those students who:
•
were participating in a PY on 11 November 2010;
•
are not due to complete their PY until after 1 July 2011; and
•
are not eligible for transitional arrangements*.
* Transitional arrangements apply to people who on 8 February 2010 held or had applied for a Temporary Skilled Graduate visa (subclass 485). Until the end of 2012, this group is able to apply for a permanent skilled visa under the points test in effect as at 8 February 2010.
It must be made clear to students that their decision to undertake or not to undertake a compressed course in no way affects the processing of any future migration application. Should they choose to apply for migration, their applications will be assessed against the legislative criteria in effect at the time they apply, in the same way as any other application. It is not possible to pre-empt a migration visa decision.
Students should be encouraged to carefully consider their options before making a decision. It is important to note that by completing a PY, students are eligible to be awarded points under either the current points test or the new points test.

Providers who choose to opt into this arrangement will need to:
1. provide the full name, date of birth and passport number of students who:
•
were participating in a PY on 11 November 2010; and
•
whose course is not scheduled to finish by 1 July 2011; and
•
are not eligible for transitional arrangements; and
•
have indicated they wish to opt in to a compressed course.
This information must include the commencement date of their PY and both the original and revised (compressed course) intended completion dates.
2. provide a statement confirming that the compressed PY program will not compromise on program outcomes and that the relevant professional body agrees to the delivery of a compressed course for this group of students.
This information should be provided in a consolidated spreadsheet to the Department of Immigration and Citizenship at independent.skilled@immi.gov.au by 9 December 2010.
After this information is received, the Department will confirm with providers which students are eligible for this arrangement. Where eligible students have an outstanding subclass 485 visa application, the Department will seek to ensure that the application is finalised before 1 July 2011, noting that no guarantees can be given about the outcome of the application.
