虽然我在电话里说得那哥们不吱声了,但是还是没给我退钱(其实现在他们还没来得及收。。。。)
queensland的fair trading给的advice:
先写信给这个公司,如果定期没有满意答复,可以由fair trading上诉。以前听到的cases都是fair trading比较站在消费者一边,这次不知道有没有运气,下回分解了。
以前的确碰到过退房的时候有argument,房东(中国人,地方不指明了)硬要我们赔因为大风损坏的百叶窗,后来在fair trading上找到依据说owner is responsible for the premise damaged caused by wind storm,告诉他如果不行就告fair trading吧,他就老老实实退款了。这个人在查房的时候连车位上有没有漏下的机油的印子都看。。。其实也没有错,不过这样有点太“苛刻”?
以下是我写的信,废话很多,目的是为了写得详细,给以后得朋友参考吧,希望有能派上用场:

Dear Adrian:
My name is XX XXXX, also known as Neo to you.
Firstly I spoke to you on 10/12/2007, in regard to a $180 charge for repairing a motor vehicle (Nissan TIIDA Rego: 616JRE) I rent from your company on 01/12/2007, which was returned at 18:30 on 03/12/2007.
That vehicle was picked up from Cold Coast Airport with some minor dents and scratches on the body and which were clearly marked on your checking list.
Now, you were saying that I damaged the driver side front bumper, I couldn’t accept that. I have a photo of that vehicle which was taken only 40 minutes before I returned the vehicle to your car park in the airport. The place was at Mermaid Beach. (The EXIF information of the photo indicated the time the photo was taken was at 17:54:39 03/12/2007; this information is not changeable at all.)
After I took these photos, I drove through Gold Coast HWY directly back to airport. The picture clearly showed that the car’s driver side front bumper remained in perfect condition, no damages, no scratches or dents.
And then you were telling me the part which was damaged was actually underneath the front bumper, and you told me the car could have hit the kerb or some rocks. But the picture clearly showed the part you mentioned was NOT damaged either.
At the time that I picked it up, your staff didn’t check underneath of the car and you didn’t tell me to do so either. Checking underneath of a renting vehicle is not a usual practice to rent a vehicle from a Rental Company.
I have been driving this vehicle carefully in all three days. If there were any little things I would notify you without any hesitation. But I didn’t make any mistake, and returned the car in original condition by the due time.
If there were some damages on the vehicle, there must have been done by someone else before I rent it and I couldn’t discover it under a usual and reasonable checking of the vehicle.
I couldn’t accept your words of what you questioned me over the phone, and you were saying: Neo, did you take a photo of the underneath of the vehicle before you drove it away to prove there was no damage over there?
Is that what you normally do when you rent a car: Lying on the ground, taking a photo of the chassis? Ok, Adrian, I am not a mechanician, I am not responsible to lying on the ground checking the chassis. If you assuming this were what I should have done, then you should have told me to do that when I picked up the car rather than after I returned it!
By the way, at the time I returned the vehicle, we followed your instruction to leave the car in the car bay belongs to your company at Coolangatta Airport and then dropped the key in your letterbox. None of your staff were there inspecting the vehicle condition. You supposed to have someone there checking it up to avoid any dispute. I trust you, but the trust honored a $180 bill for me.
And you should have notified me before you carried out a repair on the vehicle rather than telling me after you’ve done it.
This would possibly indicate someone else rather than me, may have driven the vehicle and damaged it.
Indeed, that damage was NOT done by me AT ALL!!!
Anyway, I would expect a reasonable explanation and refund of the $180 to my credit card. I would NOT pay for any mistakes that I didn’t make. And if I won’t hear a satisfied reply from you and the full refund with 14 days from today, I will have no choice but to sue your company to Commissioner for Fair Trading Queensland. If I have no choice but to make it onto the next step, all relevant documents and evidences will be forwarded to Commissioner for Fair Trading Queensland promptly.
I wish we can solve this without going further to some unnecessary legal process.
