2009年7月,我把楼上的open living area 和dining area 加了3面墙改成 一个study room 和一个 living room。已建好,建的时候不知道(因为卖房子的seller说不涉及到structure的改变,所以没关系)
后来被strata发现,并逼着向council申请过CDC,结果被withdrawn, 说我这个是已经建好的了,不能申请这个。
council的人有来看过说我这个符合标准(通光,没火灾危险,没个common area 连接。。。。),
说我可以不用申请任何东西,也可以申请 building certificate 149D。
但是 strata 说我如果不拿到 council 的approval 就必须拆掉。。。
我咨询了council的人,他们说那你就申请 building certificate 149D。

As advised previously, you are not able to obtain a "Complying development Certificate - Approval" as the works were carried out without approval.
The only way to get some form of certificate from council for the works that have been carried out is to apply for a " 149 Building Certificate", this is an application, fee and supporting documentation for the works that were carried out.
My advice about the room layout was that in my opinion the works would appear to comply with the Building Code of Australia and had an application been submitted prior to the works being carried out, it would have been approved.
然后council又换了个人来看了,当时说问题不大。
回去又给我打电话说她和她的manager讨论了一下,说我这个有可能不当做bedrooms,必须拆掉。
我没办法,给council的general 邮箱发邮件,他们回复说我可以申请另外一个,他们会给我批复。

I have had discussions concerning this matter with Noelle, her manager Roman Wereszczynski and the Manager Development Assessment Kerry Kyriacou.
Following our discussions we have concluded you should lodge a development application (DA) for the "use" of the altered spaces within the apartment. We cannot give retrospective consent for any unauthorized buildings works but we can for a "use".
There is an application form for a DA and an information sheet on the Council website. You will need to fill this out, include relevant information (Statement of Environmental Effects and plans), pay the required fee and return it with owner's consent to the Council. The DA will then be assessed by us.

我又重新作材料,找strata盖章等等。
过了段时间,council也没人来看房,直接回复了邮件说我必须得拆掉,不然罚款1.1million什么的。
我再给之前council发邮件给我说可以给我approvel的人发邮件,那人就不回复也不理我了。
结果现在council全都不承认了,现在只能给我多30天把墙拆了。这事前前后后都快4年了,翻来覆去的折腾我,要是第一次就说不管怎么申请我都得拆我何必花那么多时间和钱去折腾呀。他们这个根本就是欺诈呀!!
各位大侠看看这两封council的邮件,都写了照着他们说的去申请,就会我批复!
我完全照着那些专家的指导来进行申请,可是他们全都在骗我的感觉。
我大概记得学过“专家”的意见导致错误的决定是可以用"negeligece"来起诉的。这里适用吗?
我还想了解一下如果我不拆的话,counicll采取的legal action会导致什么结果?court强制执行我拆除强?罚款?

觉得council的专家就是在骗我的申请费,我现在就算是要把墙拆掉,如果可以告council的话我也要起诉他们!谁知道了解这方面的律师麻烦推荐一下。
