Hi all,

Sorry for unable to type Chinese.I have a question about staff payroll & roster.

In a retail business, I find the new manager has changed all casual staff to P/T in order to pay them lower hourly rate. But does P/T staff should have a fixed time to work every work, shouldn't as flexible as casual?

If they changes every week, say this week Monday only 9:00-4:00, next week Tuesday 2:00-5:00. It cannot process their public holiday pay when it comes, and cannot allocate to the right person entitle it. Am I thinking the right way?

I am very confused about this. Is the manager doing the wrong thing? Hope ZUJI kind people can give me some instructions about this chaos. Much Appreciated!!

There are a few issues when change from casual to part-time:
1) change from casual to part - time need based on new contract, does all those casual employees have new contracts?

2) the new contract need identify the contract hours per week. part-time can work different time or days each week but they need to be given enough work hours per week. If the employer doesn't give part-time employees enough hours to part time employees, the employer still need pay contract hours regardless how many hours the employees worked for example if the contract hours for a particular employee is 25 hours per week, but the employee only work 20 hrs for that week because manager didn't roster enough shift for this employee, the company still need pay 25 hrs

3) the new contact also need states the work days in the week which judge the public holiday entitlment. For example, if the employee roster on Monday - Thursday, when Monday is public holiday and the employee didn't work on that day, but he/she is still entitled to be paid on that day because it is his/her roster day

4) all leave entitlment will be accrued based on contract hours per week, long service leave should be accrued since the commencement date not the date change to part-time roles

Hi Vivien. Thanks very much for your kindly reply.

1) there is just a verbal agreement with the staff change to P/T, no paper contract has been signed yet.

2) If the contract being made, is there a minimum weekly working hours. Can a part- time contract be made for working 10 hours per week, for example, or staff can work more hours than agreed hours on contract if needed?

I guess basically, the manager want to use the Part- time staff as causal, who has no fixed working time. Because in this company, part- time hourly rate is cheaper. She doesn't give staff regular fixed time in roster. P/T staff working days changes every week actually.

This isn't the right way to do this, is it?

1) change contract need formal document to support and it is not legal and formal to change without contract

2) Part time employees can be set up for any hours as long as more than the minimum shift requried by the industry Award. The employees can work more than the contract hours however if it happens all the time, should change the contract to reflect the correct hours

According to Fair work, the part time rate is different with the casual rate as the casual rate should be higher and including casual loading. Also if your boss change them from casual to part time without roster hours and days, how you can accrual the leave entitlment for them? it should be balanced - if your manager choose changing them to PT and pay lesss, need accrual all entitment for them, otherwise pay casual rate with casual loading
