手頭上有些錢,不多,只能選西南home and land package,建築商是Trend Connection
建築合同上有一條寫明建築商不需要拿OC-如下
但房子Tender上有一條 "Facilitate in obtaining an Interim OC" -如下
律師說一般建築商會在合同上把這條改掉或另加一條說會幫買家申請OC
幾次溝通下來,建築商只答應在房子Tender上把Interim去掉,在email也回復說會提供OC,就會不肯改HIA建築合同.
原話 1 - We don't agree to delete the word "not" in clause 22 of the building contract, because the HIA is a standard contract which covers all types of building work. In this case our tender has states we facilitate to obtain the Occupation Certificate already so no need to change the contract.
原話 2 - As per my last email, we do provide Occupation Certificate, we are happy for you to amend the tender, but please leave the HIA standard item as it is.
律師理解為,房子建好後,建築商會提供申請OC的文件,但需要我們自己去申請.
這樣我們不多子少會有風險
現賣房中介和建築商溝通過說,可以叫律師以邮件方式,以我們認為滿意的語言要求建築商提供OC,建築商再以邮件回復確認.
還沒來得急問律師這樣做在法律上是否有效,還是說一切以建築商合同上為準.
心里沒底,所以想問問各位 |
