协议就是协议,我不觉得房东会愿意退款,AIRBNB网站也明确写了不保障楼主的情况。说到底房东也是受害者,而且事实上他的房子本来可以出租给别人,出于利益考虑当然直接拿钱符合他的利益,而不是接受退款,然后再找租客。楼主租这房子,本来应该做好预案。
然而这样的合同是否可以取消不仅仅看AIRBNB的规定,还要看其他法规。我查到的来自ACCC的信息,当然如AIRBNB所解释,既然COVID已经是事实了,预定住宿的时候某种程度上应当有预想或许会遇到这样的情况,可能都不能算意外情况,这种前提下,是否CONSUMER LAW还保护楼主也存在疑问。但是楼主可以咨询下ACCC。另外有一点是楼主可以继续行程,只是出于担心不愿意,把这个加入考量的话,楼主赢面可能更小。
