2.non-compete期间有工资不？或附带一定薪酬的协议，没有的话是否违法？

In contract law, a non-compete clause (often NCC), or covenant not to compete (CNC), is a clause under which one party (usually an employee) agrees not to enter into or start a similar profession or trade in competition against another party (usually the employer).

1. depends on if there are damages due to break of non-compete contract. If significant damages are identified you will be brought to court. If not it will be less likely but the breacher are subjec to risks of getting on court, or settlement required in the contract

2. 由协议决定。
3.3-12个月居多
non-compete期间不给pay并不违法。但个人完全可以不签这样的协议或者入职之前negotiate要求pay.
就算协议上写了有non-compete,并不意味着它是reasonable和enforceable的。到法庭上的话，由法官进行判断。

澳洲这边，without pay 或者比较低的non-compete 一般 enforceable不？
有真实案例不？

大部分non-compete都不是enforceable的，毕竟成本太高，也把人得罪了

但是还是得注意看合同，能避免就避免

只能说问一嘴，真正这一条是很多公司的legal来enforce的，真的来了其实也很难避免

雇佣方不给赔偿，不就是non-enforceable?还敢追上court？

我的意思是，在对方不给赔偿的前提下你违反了non-compete的条件
比方说加入了甲方或是竞争对手的公司
取决于对方有多么鸡飞狗跳，他们也有可能追究的

而你的新公司的合同里面应该也提到了，任何因为non compete带来的费用都需要你个人承担

这个的极端情况真的会很让人烦恼，所以在能避免的情况尽量避免

这个其实就是牵涉到顶楼问的问题了：到底在澳洲不给赔偿的non-compete是否enforceable。

当然有可能是enforceable的。有些国家不给pay是不enforceable的，可惜这里不在其中。
