谢连斌案上诉前疑点讨论

2017年1月 谢连斌被认定为在2009年7月18日凶杀悉尼恩平林家5口人的独狼凶手，并判予5个终身刑期

2017年3-4月 谢连斌提出上诉。NSW legal aid 批准全资支持，并经谢连斌同意任命了一位sc 大律师领衔的上诉小组

2018年12月 谢上诉小组与应诉方2次在法庭上法官面前商议上诉开庭日期，应诉方要求延期。最后定于2019年10月中旬开庭，为期5天。2019年5月双方还会在法官面前见面，最后确定开庭日期


一直感觉此案为冤案，疑点不少，愿继续讨论，特开此贴
建议参加讨论者，除了针对原检方提出的诸多circumstantial evidence，讨论时尽量附上论点的论据
以下是疑点之一：



“The Accused seeks to rely upon part of Dr Perlin’s report dated 26 March 2014 as providing evidence of Ms AB’s DNA being contained in Item 550, noting that this conclusion would mean that Item 550 cannot be linked to the crime scene, as Ms AB is alive (MFI29, paragraph 80).

The Accused made submissions concerning the concept of shadowing, mentioned in Dr Perlin’s evidence with respect to this report. Further submissions were made by reference to Dr Perlin’s report, the results of which were said to indicate that Ms AB was present in the crime scene samples and, in particular, Item 223, a swab taken from a wall in Bedroom 3 (the bedroom of Henry and Terry Lin). This sample was a direct swab of blood and it was noted that Ms AB was not present and did not bleed. This aspect was relied upon to challenge the reliability of Dr Perlin’s evidence.”

Dr Perlin 是True Allele DNA分析技术的作者和拥有者。True Allele证据是谢有罪认定的主要根据。Ms AB 是林家孤女Brenda 的代号。Item 550 就是stain 91，也就是在谢家车库地面案发10个月后发现的污迹

法庭报告里的这两段，讲的是在True Allele 的初始报告之后，辩方要求Dr Perlin 在他被提供的5个 DNA样品里，再加上Brenda 林作为检查对照目标。Dr Perlin 答应了并按要求做了检查，结果就是如上：活着的Brenda的DNA，也被发现在item 550 和 item223里面了。Item223是在受害男孩房间墙上采取的一个血样本

辩方据此认为True Allele 技术不可靠，item 550 也跟凶杀无关，不然还活着的Brenda的DNA怎么也会在里面呢？Brenda的DNA怎么会出现在男孩房间墙上的血样本呢？

我一直在找True Allele 对item 550/stain91 里面Brenda DNA数据，还没找到
怀疑这数据高于另2女性受害者的数据，不然的话检方应该早就广而告之了

如果怀疑被证实的话，这item550/stain 91 的定罪意义就荡然无存了

而一个初次杀人犯一夜把痕迹清理的如此干净，我不信。

那些说是冤案的，我觉得都是在装逼，以为自己有多牛逼，刷刷存在感！ 不管是不是他干的，性侵妇女就应该关一辈子，看上去就是个坏人，难怪陪审团11:1定他有罪，陪审团就是和我一样的普通老百姓，都觉得他是个坏人！如果证据链100%完整，还要什么陪审团？

作案肯定不是一个人谢可能是其中一个，也有可能根本不是，但是对警察来说搞谢最容易. 要抓住其他凶手或者真正凶手对土澳警察来说是mission impossible

警方公布了谢轻抚低头学习的Brenda的肩头的录像， 这个也许另有深意，实际上等于明白无误地说，我们录像监控在谢家的谢和孤女了（为了孤女的安全应该会监控孤女房门），这是最最最那个的了，从而孤立了或者甚至对立了某些关于在谢家特定时间段内发生事情的证词。

“Submissions were made by reference to Dr Perlin’s evidence concerning mixture weights. It was submitted that Dr Perlin’s report of 26 March 2014 (Exhibit PTK20), being the report provided by Dr Perlin in response to the defence request (concerning Ms AB) made in the course of the pretrial hearing, provided an insight into the complexity of the mixture. Reference was made to concepts of shadowing and false positives, which were said to manifest the actual difficulties which TrueAllele has in dealing with five-person related mixtures which are compromised. It was said to constitute effectively an acknowledgement of an important area of imprecision in TrueAllele’s capacities, being an imprecision previously demonstrated by the differing likelihood ratios in Dr Perlin’s first two reports, and the error corrected in the third report that arose in applying an incorrect theta value.”

这一段紧接着#1 法庭文件那两段，-274

从这里我看到了前述关于True Allele查到活着的Brenda的DNA也出现在item550/stain 91 和item223，是26/03/2014True Allele对这个案子多个DNA样品的第三次检查分析，用了不同的theta比值。第一第二次也得出不同的数据。辩方讨论时引进了阴影化和假阳性概念。辩方说这一切说明了True Allele技术在分析5人混杂DNA样本时的不准确和局限，是True Allele 技术的重要特点

记得在另一个法庭记录辩方指出True Allele 是个还不成熟的新技术，在林家血案DNA的3次分析结果都不同

我相信这些证据在上诉法庭上，三位法官都会懂
陪审团忽略这关键证据，是陪审团三大弱点之一：缺乏对技术证据的理解和判断能力，在这里的表现

谢在出事以后根本不能和Brenda 单独接触，土澳警方肯定会严密监视的，华人的文化觉得没啥，但是西方文化就是这样的，周围人全部严密监视，为了破案这是必要的，毕竟重大人命案件阿

DAL是NSW卫生局属下的特别分析实验室

从这里看到，林家血案凶场至少采集了640个DNA样本，一开始是在卫生局属下实验室做实验的
结论是“里面没有一个样品的DNA档案与item 550的一样。。。”

这还是#1法庭记录的一部分，-350
辩方说True Allele 不成熟，还在成长中。检方回答说True Allele 并非“ an unfinished product.”, 还说True Allele 问世5年已经更新到第25版！

这实际上不是在承认还没成熟，仍然是个“unfinished product ” 吗？

换句话说，那些几百几千倍数的根本没有意义，有意义的应该都是上亿的倍数。

而Irene的的倍数根本没法跟俩个小孩的数量，不在一个数量级别上，事实上是可以忽略的。

a)   a match between a contributor to Stain 91 and Yun Bin Lin is 4,410 times more probable than a coincidental match to an unrelated Asian person;

b)   a match between a contributor to Stain 91 and Yun Li Lin is 27.1 times more probable than a coincidental match to an unrelated Asian person;

(c)   a match between a contributor to Stain 91 and Min Lin is 379,000 times more probable than a coincidental match to an unrelated Asian person;

(d)   a match between a contributor to Stain 91 and Henry Lin is 1,330,000,000 times more probable than a coincidental match to an unrelated Asian person; and （应该有Henry的DNA）

(e)   a match between a contributor to Stain 91 and Terry Lin is 1,030,000,000,000,000,000 times more probable than a coincidental match to an unrelated Asian person. （一定有Terry的DNA）

P.S: 1 quintillion = 1,000 quadrillion;
        1 quadrillion = 1,000 trillion;
        1 trillion = 1,000 billion;
         1 billion = 1,000 million.

你那看上去就是坏人的言论实在让人惊恐。希望你不会被选入任何陪审团。另外陪审团的作用其实是降低冤案的风险。法官不可以否决陪审团的无罪判定，却可以推翻陪审团的有罪判定

性侵是性侵，杀人是杀人。性侵并未被正式作为案子审讯，谢也并未因性侵定罪。且性侵即使被定罪，其本身也不能被判处终身监禁，哪个国家也不会。请别用所谓代入感来看问题。非理性的回帖是不受欢迎的。

但是 污渍里有死者DNA的可能性都有数量表现 排除孤女DNA的数量表现是怎样的呢？为什么不公布？

stain91 DNA分析报告里说有几个人DNA，那是一种模糊，不正确的表达方法
我们知道除了同卵双胞胎，每个人的DNA都是独特的。而亲戚之间的DNA则有不同程度的重叠或部分相同。没有明显亲戚关系，而远祖可能有血缘关系的不同个体的DNA也可能有一定的重叠或小部分相同

stain91DNA分析报告里说有几个人的DNA，指的应该就是，stain91 里面的DNA，有部分与林家血案受害者几个人的部分dna重叠或相同。而True Allele所引用的几率数字，指的就是这种重叠或相同的程度

再重温以上True Allele 对stain 91 DNA的分析结果
Yun Bin Lin 是 Irene，也即林暋的妻妹
Yun Li Lin 是 Lily，也即林暋的妻子


与不相关亚洲人/unrelated Asian person 相比，Irene和Lily DNA与stain91DNA 的相似度分别高了4410 倍和27.1倍

但Irene 和Lily是不相关亚洲人/unrelated Asian person吗？ 不是的：

1）她们是相关性比一般“不相关亚洲人”更强的中国人
2）都姓林，远祖上有关联的可能性高
3）林老人是广东潮汕人，而Irene和Lily父母是福建闽南人，潮汕和闽南地理上相邻，语言相通，文化习俗也类似，远祖上都由同一地区迁移而来，据说1949年差点把广东潮汕和福建闽南合并作一个省

如果考虑以上这几个因素，很明显，如果说不相关亚洲人的DNA有1个allele与stain91DNA相似，Lily的DNA有27个allele与stain 91DNA相似，Irene的DNA有4410个allele与stain91DNA相似，即使她们的DNA不在stain91，毫不奇怪

而3男受害者的379000；1330000000和1030000000000000000数值，明显把他们与2女受害者分开，完全在一个不同的级别

换句话说，Lily和 Irene在 True Allele分析结果的这两个数字，无法得出：她们的DNA也在stain91里面 ，这样一个结论

“Mr Andrews had noted that the prosecution had described the murder of Mr Xie's brother-in-law, Min ''Norman'' Lin and four members of his family, bludgeoned and strangled in their beds, as a crime of extreme violence and personal hatred but was unable to establish a clear motive for the crimes.

''It was effectively conceded by the prosecutor that there was no evidence of motive.

''On the contrary, the evidence indicates a very close relationship between the families.''

He also noted that there were weaknesses in the DNA evidence from a spot of blood found on Mr Xie's garage floor.

The prosecution said it contained a mix of at least three different kinds of blood, at least one of which had virtually identical characteristics to one of the victims.

But the court has heard that the female DNA contained within the sample may not have matched the two female victims of the murders.

''There is no doubt that the total exclusion of Lily [Lin] and Irene [Lin] as major contributors puts the prosecution case based on DNA evidence in a different light, and makes it a weaker prosecution case,'' Mr Andrews had said.

The Crown prosecutor, Mark Tedeschi, conceded that the prosecution case ''may not be an overwhelming one''.

以上是2012年12月初审/committal hearing 的新闻报道。从里面我们看到：
1）当时检方也承认被告没有明显动机，证据显示谢与林家一家关系极好
2）DNA分析把2女受害者排除在stain91 的可能贡献者之外，法官John Andrews 因此说make It a weaker prosecution case
3)  DNA 分析发现stain91含有另一女性DNA：But the court heard that the female DNA contained within the sample may not have matched the two female victims of the murders.

我相信这另一女性就是孤女Brenda Lin。在另一个报道提到这另一个女性是还活着的林家女性。而True Allele在#1 里的它对林家血案DNA样品分析的第三个报告里证实了Brenda Lin DNA 出现在 stain 91/item 550

至此我敢肯定，Mark Perlin 一直不敢发表的Brenda DNA在stain91/item 550相配数值，远远高于2女性受害者的这个数值。不然就不会有以上这个早期DNA分析结论：stain91 含Brenda 林的，而不含2女受害者DNA

这样一来stain 91 作为林家血案凶场证据，已经站不住脚了
