Do fines $200 for not having fishing licenses apply to kids?

Hi Friends,

Two months ago my family went for a swimming and snorkelling , in a beach next to the Golf course at La Parouse.

My six year old son found some sea urchins. He was excited to take one to his mum, though I told him that it was spiky and do not touch it. While my wife was so bored (she did not swim) and she saw that a group of other people were cutting sea urchins, she tried to find out what it is inside sea urchin and started cutting the shell.

Just at this moment, two fishery patrol staffs appeared and gave my wife a $200 fines for not having licenses. I told them that it was my son who took the sea urchin, not my wife. But the fishery staff said that as parents, we have the responsibility to buy fishing licenses for kids.

Later my wife paid the fines to avoid argument with the staff. However, I did not think that it is right, as children under 18 do not need fishing licenses.

Is my understanding correct? Is it possible to discuss it with someone to get a refund?

This is not a question general anglers can answer. Speak with a lawyer. The moment you paid the fine is equivalent to agreeing that you have committed the offence.

The mother opening sea urchins reminds me of an old idiom advising one to avoid appearances of impropriety:
"Do not put on shoes in a melon field; do not don a hat under a plum tree."

2.an adult assisting a person under the age of 18 to take a fish using a single rod or to take prawns using a single dip or scoop net

Based on the information, it seems that my wife does not need to pay the fines, as my son is 6.

To be honest, the whole thing made me angry, not because we paid $200, but because it scared my son and my son did not want to go to that beach and do any fishing any more. The fishery staff was a monster to him, and my son did not want us in trouble again.

I wish that the fishery staff could apologise to my wife, and so my son could feel comfortable going to that beach again.

Is it possible that I can talk to someone about it?

To be honest, I think that fishery officer gave us the wrong information. He said that as guardian or parents, we need to buy fishing license for our son.

上法庭申诉，很大概率能豁免这笔罚款的。

根据新洲法例，你应该有理的。程序是，你坚持不交罚款，渔政来信最后通牒，你回他们法庭见，那就会真的法庭见了。

我因为停车罚款上过法庭，申述自己的理由，提交证据，当庭就豁免罚款。等侯时，见好多老外上庭的，或申述理由或求情，过半被豁免或减免的。

第一lz老婆自己一个人在敲sea urchin? 第二老婆肯定不是18岁吧?, 第三lz老婆肯定不是在assist他的儿子钓鱼抓虾捞海胆吧?,第四渔政的理由有点牵强,至少罚钱也是老婆的个人行为,而不是为了没有给儿子买渔政.所以lz去告吧

Thank you for the suggestion. Can you tell me how long it takes to be in the court and how difficult to handle it?

We have never been to court before. We always paid fines to avoid headache, even though we thought that fines were not right. I think that we need to try it next time?

I think that you are right.

My wife is a nice woman. She paid the fines in the first place to avoid headache. I think that next time we need to learn to argue about it.

从罚单开出那天算，总计约半年。

上庭一点也不复杂，有证据拿出证据，有理由就申述。都没有，光是求情，有时都管用的（亲眼目睹）。

时间就花了上庭的半天，免了罚款（也不多），是否合算是见仁见智的。有空的话，我是一定上庭的。

感觉楼主遇到骗子了。执法人员一般不会当场开罚单的，都是记录详细信息后，邮寄罚单给你（并且详细注名你有哪些offense ).另外如果是当场付现金罚款就更不可能了。

另外，执法人员说“But the fishery staff said that as parents, we have the responsibility to buy fishing licenses for kids.”。这基本不大可能的。。。。怎么可能啊。。。。。

另外，他们在给你罚款之前，一定要出示他们证件，以及给予详细资料并了解抓Sea Urchins是否楼主/或楼主LP有特殊医疗需求或是有土著人证件。

直接就给罚款，哪那么简单。
