Legally, whether you are entitled to OT pay are determined by, 1. Whether you are covered by an award 2,your employment contract.
Such as office work ( 白领),normally, managers and professionals ( such as Accountant, IT, and HR) are not covered by any award, so they are not entitled to OT pay; but for many other positions, such as accounts officer, payable , receivable, office administrator, receptionist etc, they are covered by the Clerk award in most of the industry , therefore legally they are entitled to the OT pay,but if there is a annualized term ( 年薪制) on your employment contract which is similar to " the salary is to compensate all your normal hours worked, loading ...and reasonable OT " , normally you are not entitled to the OT pay unless your overtime hours are excessive.

以前一个accounts officer 在离职的时候,跟公司算账要求付OT hours, 那个员工做了很好的记录,但最后还是没付给她,因为就是把她所有的Normal hours 和 OT hours 按照award d最低rate 都加起来,还是略低于她当时的年薪,其实也就$48k. .
一般的clerk 的最低小时标准在$20元左右(看LEVEL), 如果你的时薪哪怕只有$23, 一般的小加班都不不会给你OT pay 的。当然很好的老板或者经理另说。 |
