突然看到这个房子,很喜欢,昨天才发合同给我的律师。律师就建议我和他们商议修改合同
general condition
stakeholding:
The deposist must be released to the vendor if:
a)the vendor provides particulars, to the reasonable satisfaction of the purchaser, that-there are no debts secured against the property with exceed the balance of the price; and
b) at least 28 days have elapsed since the day of sale; and
c)all conditions of the Sale Of Land Act 1926 have been satisfied
律师建议我和他们商议改成这样
It is recommended that you amend this General Condition to say:
(a) the vendor provides particulars, to the satisfaction of the purchaser, that either –
(i) there are no debts secured against the property; or
(ii) if there are any debts, the total amount of those debts do not exceed 80% of the sale price; and
之后中介这么回复我,等我收到回复了,我的律师竟然已经下班了。
一开始回复: “Contract of sale: the purchaser does have a mortgage on the property. Whoever buys the property will be given clear title to the home without any debt on it. This is standard practice in the sale of real estate.
In this case you are already covered by law if you are concerned.”
之后再回复:“The final approval for release of deposit under section27 of the act is for the purchaser to agree to having it released on the advice of their conveyancer/ solicitor.
The details of the mortgage outstanding will be supplied by the vendors solicitor to your solicitor if you do in fact purchase the home.
I suggest that you speak with your solicitor conveyancer for clarification on this matter as this is standard practice in the requisition stage after purchase.
I would never expect a deposit release under duress of owed monies and I have never seen a purchaser/ solicitor allow it.”
我上班不能用手机,等有时间联系律师她已经下班,三点就下班了!!我应该能怎么做?房子是很喜欢,但是真的不确定这个条款能不能接受。
我就是怕有意外情况出现,晚上中介打来,房东愿意修改合同,总算解决了
